HomeMy WebLinkAboutResolution No. 053-20 - Resolution Approving Broadway Reconstruction Assessments 02032020 RESOLUTION WHEREAS, pursuant to proper notice duly given as required by law, the common council has met and heard all objections to the proposed assessment for Improvement Project No. th J7318, the Reconstruction of Broadway Avenue North from Civic Center Drive to 13 Street NW; NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota: 1. Such proposed revised assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment roll for the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. The owner of any property may prepay the entire assessment to the City Clerk whose office is located at 201 Fourth Street SE, Room 135, Rochester, Minnesota 55904. No interest is charged to a prepayment made within 30 days of both adoption of the assessment by the Common Council and written notice from the City that the assessment is due and payable and set for certification to the county auditor for collection (the 30-day interest free period). Prepayment outside the 30-day interest-free period is allowed any time prior to certification of the assessment or the first installment thereof to the County Auditor. If prepayment is made prior to November 15, interest shall be charged from the beginning of the 30-day interest free period to December 31 of the year of payment. If prepayment is made after November 15, interest will be charged from the beginning of the 30-day interest free period through December 31 of the next succeeding year. If prepayment is not made, the amount will be certified to the County Auditor to be spread on the tax rolls over 10 years at an annual interest rate of 5.00 percent on the unpaid balance amortized. 3. Certification shall occur when the project is substantially complete. At that time the clerk shall transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. 4. Such plans and specifications authorized and directed to advertise for bids in accordance with the specifications on file in the City Clerk’s Office. The city clerk shall prepare and cause to be inserted in the official paper (and on Egram) an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published for 21 days, shall specify the work to be done, and shall state that bids will be received by the clerk until 11 a.m. on a future date to be determined, when they will be publicly opened in City Hall by the City Clerk and two designated City Officials. The proposals will then be tabulated and presented for consideration by the Common Council at the next appropriate meeting.
