RESOLUTION
WHEREAS, PEBBLE CREEK ROCHESTER, LLC., owner, has shown to the satisfaction
of the City of Rochester Common Council that it has complied with all conditions of
approval imposed upon its Land Subdivision Permit (Final Plat) and all applicable laws
and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on April 20, 2020, the following plat
of lands in Olmsted County, Minnesota are to be known and designated as follows:
FINAL PLAT DESCRIPTION:
That part of the Northeast Quarter of Section 13, Township 107 North, Range 15 West,
Olmsted County, Minnesota, described as follows:
Beginning at the northeast corner of Lot 10, Block 4, PEBBLE CREEK, according to the
recorded plat thereof; thence North 89 degrees 51 minutes 39 seconds West, assumed
bearing, along the north line of said Block 4 and its westerly extension, 598.42 feet; thence
northerly 273.40 feet along a nontangential curve, concave westerly, central angle of 41
degrees 33 minutes 03 seconds, radius of 377.00 feet and a chord which bears North 07
degrees 57 minutes 41 seconds East, 267.45 feet; thence South 89 degrees 51 minutes
39 seconds East, not tangent to said curve, 562.02 feet to the westerly right of way line
of 61st Avenue NW as dedicated on the plat of said PEBBLE CREEK; thence South 00
degrees 08 minutes 21 seconds West, along said westerly right of way line, 264.96 feet
to the point of beginning.
Containing 3.43 acres, more or less.
TO BE KNOWN AS PEBBLE CREEK SECOND, submitted by Pebble Creek Rochester,
LLC. owner, is hereby approved and all dedications of land or interests in land for public
purposes as shown on said plat are hereby accepted, subject to the following conditions:
1. A Development Agreement and Supplemental Development Agreement have been
executed and recorded for lands including this proposed subdivision. Development
is subject to the terms of the existing Agreements.
2. Execution of a City-Owner Contract will be required prior to construction of public
infrastructure to serve this Property. Charges / Obligations applicable to the
development of this Property shall be paid consistent with the terms of the
Development Agreements and City-Owner Contract.
3. The applicant shall submit a revised Preliminary Plat, which shall include the
following changes:
a) A public utility easement that follows the geometry of the corner lots, to the
satisfaction of Rochester Public Utilities.
b) A temporary turn around located at the terminus of Sandstone Street NW.
4. Prior to recordation of the Final Plat, the applicant shall dedicate 1.98 acres of land
for the required parkland dedication.
5. A revised Final Plat shall be submitted which demonstrates a public utility easement
that follows the geometry of the corner lots so that the easement is no less than 10
feet at any point. Required revisions include: the south west corner of Lot 1 block 1;
the south east corner of lot 9 block 1; and north east corner of lot 1 block 2.
6. A temporary emergency access turnaround capable of supporting the weight of
responding fire apparatus, shall be installed at the west end of Sandstone Street
NW to the satisfaction of the Rochester Fire Department.
7. Prior to recordation of a final plat, applicant shall provide documentation of a
recorded temporary turn-around easement at the west end of Sandstone Street NW,
to the satisfaction of the Rochester Fire Department.
8. The applicant’s boulevard tree obligation shall be met prior to recording the Final
Plat.
