HomeMy WebLinkAboutResolution No. 139-20 - Sound Amplification Waivers for Drive-In Theaters (walk-on) RESOLUTION WHEREAS, the City of Rochester supports efforts of local businesses to diversify their income stream through creative and safe measures during the COVID-19 pandemic. Of these measures the City plays particular attention to the growing interest in pop up on- premises Drive-In Movie Theaters. WHEREAS, a Drive-In Movie Theater is defined as a form of cinema structure consisting of a large outdoor movie screen, a projection booth, and a large parking area for automobiles. Within this enclosed area, customers can view movies from the privacy and comfort of their cars. WHEREAS, the sound element of these Drive-In Movie Theaters makes the obtainment of a Special Event/Sound Amplification permit a requirement for these gatherings per Rochester City Ordinance Chapter 8-11-1 which thusly states: Special event. (1)The term "special event" means an event held in the city in which one of the following occurs: a. Amplified sound is to be used; WHEREAS, the City Council of Rochester, recognizing the prohibitive nature of such a permit, and the time delay such permitting creates, does hereby waive the requirement for such a permit in relation to Drive-In Movie Theaters insofar as the events are related to Restaurants, Bars and other places of Public Accommodation currently facing closures due to Executive Order 20-04 WHEREAS, this waiver is in effect only for the period of time that Executive Order 20-04 remains effective and upon the expiration of said order, this waiver and this Resolution is so too expired. WHEREAS, nothing in this Resolution acts to change any other element or requirement of Rochester City Ordinance Chapter 8-11 and all other elements retain their current meaning and binding nature. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the City recognizes the gathering of individuals in their vehicles for Drive- In Movie Theaters as a practice that is allowable so long as all precautions taken rise to level of being safe and in compliance with social distancing guidelines put forward by the Center of Disease Control and the State of Minnesota.
