HomeMy WebLinkAboutResolution No. 142-20 - CD2020-009 PLAT Final Plat for 37th Street Business Park RESOLUTION WHEREAS, CHS, Inc., owner, has shown to the satisfaction of the City of Rochester Common Council that it has complied with all conditions of approval imposed upon its Land Subdivision Permit (Final Plat) and all applicable laws and ordinances; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on May 4, 2020, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: FINAL PLAT DESCRIPTION: th Lot 1, Block 1 and the North 15.00 feet of Lot 2, Block 1, 37 Street Business Park, in the City of Rochester, Olmsted County, Minnesota. Containing 1.28 acres, more or less. TO BE KNOWN AS “REPLAT OF LOT 1 AND PART OF LOT 2, BLOCK 1, 37TH STREET BUSINESS PARK”, submitted by CHS, Inc., owner, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to recordation of the Final Plat, the applicant shall record a private Utility Services Agreement/Easement to address the private utility services that will cross the proposed new lot lines created by this plat. Documentation of easement shall be submitted to the Community Development Department prior to execution of the plat. 2. The applicant shall provide a revised final plat that demonstrates Controlled Access along the entire frontages of Lot 1, with the exception of the area identified as a private access easement along the west property line of said lot. 3. Prior to recordation of the Final Plat, the applicant shall record the private access th easements that provide ingress/egress to both lots to E. River Road NE and the 37 Street NE frontage road. Documentation of easement shall be submitted to the Community Development Department prior to execution of the plat. 4. A minimum 24 parking spaces are required for the convenience store use on Lot 1. Prior to the recordation of final plat, the applicant shall record a parking agreement, that will allow Lot 1 access to a minimum of 11 parking spaces, which are currently located on proposed Lot 2, as to comply with the requirements of the Land Development Code and the 2003 approved site plan. Documentation of easement shall be required shall be submitted to the Community Development Department prior to execution of the plat. 5. Prior to the recordation of the Final Plat, the applicant shall receive approval of a planting plan from the City of Rochester Parks Department, and plant 7 trees in the East River Road planting strip; or, in lieu of planting trees, the applicant may pay a fee to the City of Rochester Parks Department for the future planting of trees within the planter strip.
