RESOLUTION
Approving a CUP Incentive Development Amendment for Proposed Signage at a
Mixed Residential Development at 15 1st St SE.
WHEREAS, Rochester Development, Inc., owner, requested approval for Conditional Use
Permit Incentive Development Amendment No. CD2020-002CUP-A, which is for proposed
signage at a mixed residential development including 146 units for short or long-term
lease, with a height of 26 floors or up to 342 feet to the top of the building. The property
is located north of 1st St SE an east of Broadway. The property address is 15 1st St SE.
The owner requests one 16.8 square feet (“sf”) blade sign, and two wall signs (363 sf
and 289 sf).
WHEREAS, the project is being proposed through the Incentive Development Conditional
Use Permit Amendment process because the proposed has previously been determined for
all signage requests to be reviewed as Type III Phase III amendments; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, the Council adopts staff findings as described in the staff report dated May 20,
2020, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 2) Conditional
Use Permit Incentive Development Preliminary Plan.
WHEREAS, on May 20, 2020, the City of Rochester Planning Commission held a public
hearing to consider this application, and adopted the findings of fact and recommended
approval subject to the condition proposed by the Planning Department.
WHEREAS, on June 1, 2020, the City of Rochester Common Council held a public hearing
to consider this application, adopted the findings of fact, and recommended approval subject
to the conditions proposed by the Planning Department.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated four conditions of approval.
BE IT FURTHER RESOLVED that the City Council approve the 16.8 sf blade sign as
requested by the owner.
BE IT FURTHER RESOLVED that the City Council approve up to 350 sf of cumulative wall
signage on the building, to be consistent with the “C” sign standard.
