RESOLUTION
Approving a Conditional Use Permit Restricted Development Preliminary Plan for a
Multi-Family Residential Development.
WHEREAS, Olmsted County Housing and Redevelopment Authority (HRA), owner, and
Center City Housing, applicant, requested approval for Conditional Use Permit Restricted
Development Preliminary Plan #CD2020-011CUP, which is for a project consisting of a 30-
unit and 36-unit multi-family residential development, divided into two development phases.
The site is 3.3 acres in size and located at the intersection of Mayowood Rd SW and
Restoration Rd SW, just south of 16th Street SW.
WHEREAS, the project is being proposed through the Restricted Development Conditional
Use Permit process because the proposed development is not a permitted residential use
in the base zoning district; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, the Council adopts staff findings as described in the staff report dated June 1,
2020, and finds the proposal meets the regulations in R.C.O. § 62.708 (subd. 2) Conditional
Use Permit Restricted Development Preliminary Plan.
WHEREAS, on May 13th, 2020 the City of Rochester Planning Commission held a public
hearing to consider this application, and adopted the findings of fact and recommended
approval subject to conditions one through eight proposed by the Planning Department.
WHEREAS, on June 1st, 2020, the City of Rochester Common Council held a public hearing
to consider this application and adopted the findings of fact and recommended approval
subject to conditions one through twelve.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated twelve conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Restricted
Development Preliminary Plan #CD2020-011CUP requested by Center City Housing,
subject to the conditions of approval shown below.
CONDITIONS
1. The Final Development Plan shall incorporate the following revisions:
a. A utility easement must be shown adjacent to the ROW, with the placement of a
junction cabinet in this easement completed to the satisfaction of RPU-

Operations Division.
b. The fire hydrant shall be moved to the southerly island.
c. The existing fiber optic line must be shown.
d. The proposed sidewalk and interior walkway must be located outside of any
public utility easements required for this development.
e. All proposed sidewalks along Mayowood Rd shall be shown in the public right-of-
way or identified in a pedestrian facilities easement.
f. An additional 17 feet (from 33 feet to 50 feet to CL) of right-of-way easement is
required for County Road 125. This easement must be shown on the final
development plan to the satisfaction of Olmsted County Public Works.
g. A reconfiguration of the angled intersection proposed during the reconstruction of
the shared-access point to minimize sightline conflicts between vehicles
accessing the existing neighboring development and the proposed development,
is required to the satisfaction of Olmsted County Public Works.
h. The final development site plan shall provide a pedestrian connection from the
east side of the multi-family building proposed in Phase I, to the existing trail
located on the east part of the site.
i. The final development site plan must indicate the type of material used in paving
the multi-use trail, and/or indicate the applicant’s intent to keep the multi-use trail
paved.
j. The south bufferyard must show all required canopy plantings located in the
bufferyard and out of the boulevard/ROW.
2. As part of the final development plan submittal, a revised utility plan is required, to
the satisfaction of RPU-Operations and RPU-Water Division with the following:
a. The existing 1” water service must be abandoned at the main during Phase II
construction, to the satisfaction of RPU Water Division.
3. Prior to the approval of Phase II of the final development plan, the Heritage
Preservation Commission shall determine if the proposed project (including
demolition of the residence) may continue; or, shall choose to recommend to City
Council landmark designation of the property; or, City Council shall approve the
demolition permit for the residence and approve the final development plan.
4. Prior to the approval of Phase II of the final development plan, a right turn lane that
adheres to Olmsted County Public Works Specifications is required along Mayowood
Road SW (County Road 125).
5. Ownership and Maintenance of proposed Outlot A (which will contain private storm
water management facilities) needs to be addressed to the City’s satisfaction prior to
recording a Final Plat for the Property.
6. Dedication of any applicable public easements are required prior to construction of
public infrastructure for this development.

a. A 17-foot access easement along the south side of the site shall be dedicated
as part of the Final Plat.
7. A pedestrian facilities agreement must be executed for the future extension of this
sidewalk along Mayowood Rd SW.
8. As part of the final development plan submittal, the existing private access agreement
for the Waters on Maywood shall be confirmed by the development to ensure that it
is adequate with any design changes from existing configuration.
9. Prior to approval of a building permit, an access permit is required through Olmsted
County for the change-in-use of the existing access.
10. Prior to approval of a building permit, a grading and storm water management plan
associated with this project shall be approved.
11. Execution of a City-Owner contract and dedication of any applicable public
easements is required prior to the construction of public infrastructure within
individual lots for this development.
12. The property is subject to a Sewer Availability Charge, Water Availability Charge, and
a Plant Investment Fee.
