WHEREAS, the pending business license application for Xiuqin Liu DBA Harmony Asian Massage at 915 Broadway Ave N has been reviewed by the Rochester Police Department, the City of Rochester Attorney’s Office and the City of Rochester Clerk’s Office and has received a recommendation for denial; and WHEREAS, following established practice and the requirements of Rochester Code of Ordinances chapter 5-15, whenever it appears to the Council that adequate grounds may exist for the suspension, revocation or imposition of probation on a license, the Council shall by resolution specify the nature of the alleged grounds and order that a hearing on the matter be held; and WHEREAS, there are multiple prongs for the recommendation for denial, including: 1. This business has a past history of license violations, and has had its license previously suspended and placed on probation. 2. The business did not submit a complete renewal application in a timely manner, and appears to have changed its operating structure, requiring a new business application, in violation of RCO 5-15-8. 3. A City inspector was denied entry to the business during open operating hours for a required annual inspection, in violation of RCO 5-15-10. 4. Unlicensed massage therapists were found to be working in the business, which was one of the grounds for prior sanctions. 5. RPD visited the business on January 28, 2020 and cited the business for operating without a license in violation of RCO 5-15-3. NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby set a public hearing for the City Council meeting scheduled for August 17, 2020, to consider staff's recommendation to deny Xiuqin Liu DBA Harmony Asian Massage’s application for a massage therapy business license.
