RESOLUTION
Approving Final Plat CD2020-016PLAT by Stencil Group, to be known as Stencil
Addition, creating two lots on 10.9 acres, located on the north side of Badger Hill
Drive NW, 400 feet west of Superior Drive NW.
WHEREAS, Stencil Group, owner, has shown to the satisfaction of the Rochester City
Council that it has complied with all conditions of approval imposed upon its Land
Subdivision Permit (Final Plat) and all applicable laws and ordinances.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on August 3, 2020, the following
plat of lands in Olmsted County, Minnesota are to be known and designated as follows:
That part of the East Half (E 1/2) of the Northeast Quarter (NE 1/4) of the Northwest
Quarter (NW 1/4), lying north of BADGER HILLS SUBDIVISION, Section 20, Township
107 North, Range 14 West, Olmsted County, Minnesota, containing in all, 10.9 acres,
more or less;
TO BE KNOWN AS “STENCIL ADDITION”, submitted by Stencil Group, owner, is hereby
approved, and all dedications of land or interests in land for public purposes as shown on
said plat are hereby accepted, subject to the following conditions:
1. The applicant shall either A) Identify on-site utility easements along the
private drive aisle leading to the future transformer location, to the satisfaction
of Rochester Public Utilities – Operations, prior to recording the Final Plat, or
B) Separately dedicate and record the required utility easement, to the
satisfaction of Rochester Public Utilities – Operations, prior to approval of a
Site Development Plan.
2. Parkland dedication shall be met prior to recording the Final Plat.
3. All Olmsted County GIS fees shall be paid prior to recording the Final Plat.
4. Dedication of a private cross access/cross utility easement between Lots 1
and 2 shall be recorded prior to, or concurrent with recording the Final Plat.
5. Charges/fees applicable to the development of this Property will be
addressed in a City-Owner Contract, and Development Agreement.
6. Execution of a City-Owner Contract is required prior to construction of public
infrastructure to serve this development. Any proposed public improvements
lying within Owners private property will require dedication of public
easements prior to construction.
