HomeMy WebLinkAboutResolution No. 046-21 - Extending Expanded Outdoor Premesis for Restaurants and Bars RESOLUTION Amending the expanded outdoor seating provisions for restaurants and bars under the declaration of local emergency. WHEREAS, On March 13,2020, Governor Tim Walz declared a statewide emergency in response to the Covid-19 pandemic and has since issued executive orders that make up Minnesota’s Stay Safe Plan, which provides rules and guidelines for re-opening the State to commerce; and, WHEREAS, On March 17, 2020, Olmsted County declared a health emergency in response to the Covid-19 pandemic; and, WHEREAS, On March 20,2020, Mayor Kim Norton issued a Declaration of Local Emergency, to which the City council consented; and, WHEREAS, On May 26, 2020, Mayor Kim Norton issued an amendment to the Declaration of Local Emergency order, authorizing the City Clerk, City Administrator and City Attorney to work with existing valid liquor license holders and Restaurants licensed through the Olmsted County Health Department to include or expand outdoor seating on the premise or into the public right of way, with certain conditions; and WHEREAS, The City Council consented to the amended Emergency Declaration on May 27, 2020, allowing expanded outdoor seating, and WHEREAS, Many restaurants and bars in the City of Rochester participated in the program allowing them to expand outdoor seating in 2020 with the assistance of the City and Rochester Downtown Association (RDA), expending resources of both organizations and the businesses to create a safe and comfortable experience for all within public and private spaces, and WHEREAS, Many restaurants and bars have expressed an interest to expand seating outside of their premise in 2021 and have indicated a willingness to expend resources to once again create a safe and comfortable experience for their customers and the public, and WHEREAS, it is unknown for how long the State will remain under the Civil Emergency issued March 13, 2020. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the City Council will continue authorization of expanded outdoor seating until the end of the State Emergency Declaration or through Sunday, October 31, 2021, whichever is later, unless otherwise terminated by the City Council. BE IT FURTHER RESOLVED, that conditions for the permit of expansion will remain the same as those issued in the May 26, 2020, Mayoral order, EXCEPT as modified by the State of Minnesota in the Minnesota Stay Safe Plan.
