RESOLUTION
Extending the downtown Mobile Food Unit (MFU) operation zone for the duration
of the discovery walk construction project.
WHEREAS, Rochester Code of Ordinances 5-21-7 so states:
“An operator may vend in the Mobile Food Unit zone subject to those restrictions and
limitations identified in the Mobile Food Unit zone map on file in the office of the city clerk.”
WHEREAS, One of the Mobile Food Unit operation zones is located on the west side of
2nd Ave SW between 3rd and 4th streets SW; and,
WHEREAS, The City of Rochester, in an attempt to modernize its infrastructure, is
embarking upon multiple downtown construction projects. Among these is the Discovery
Walk Construction Project; and,
WHEREAS, The Discovery Walk Construction Project will reduce vehicular access and
parking options within the 2nd Ave SW MFU operation zone; and
WHEREAS, Construction is forecast to begin in early June of 2021 and go through the
summer of 2023; and
WHEREAS, Due to the length of construction and the impact on a high demand MFU
operation zone, a temporary extension of the downtown zone is viewed as warranted and
accommodating for the MFU entities so impacted by City construction; and,
WHEREAS, The Rochester City Clerk’s Office and Rochester Public Works Department
have engaged with the Mayo Clinic to verify if a proposed alternative zone adjacent to
The Mayo Clinic Harwick Building is viable; and,
WHEREAS, The Mayo Clinic has agreed to the Cities proposal to use the four parking
spots adjacent to The Mayo Clinic Harwick Building as part of a new MFU downtown
operation zone.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester
that the City Council will expand the downtown MFU operation zone to be inclusive of the
four parking spaces on the northbound side of 3rd Ave SW, adjacent to the eastern side
of the Mayo Clinic Harwick Building and south of the intersection with 2nd St SW.
BE IT FURTHER RESOLVED, that this expansion will remain in effect through December
31, 2023, or until construction on Discovery Walk is completed, whichever occurs first.
BE IT FURTHER RESOLVED, that adjustments as a result of the pandemic or
construction are authorized, and to be executed by the City Clerk as needed.

Exhibit 1 – Current Operation Zone facing Discovery Walk Impact
1. The below images are for the west side of 2nd Ave SW between 3rd and
4th streets SW;
2. This zone allows for MFUs to operate daily between 9:00 a.m. and 2:00 p.m.;
3. There are signs in place identifying this as an MFU zones with
designated parking. There are no meters currently at this location.
Exhibit 2 – Proposed Temporary Operation Zone
1. Operation zone to be inclusive of the four parking spaces on the northbound side
of 3rd Ave SW, adjacent to the eastern side of The Mayo Clinic Harwick Building
and south of the intersection with 2nd St SW;
2. The parking spaces will be 83-12, 83-13,83-14, and 83-15 circled below;
3. The proposal will allow for MFUs to operate between 9:00 a.m. and 2:00 p.m.;
4. Signs will be put in place identifying this as an MFU zones with designated parking
