RESOLUTION
Approving a Pilot Program to Allow Review Under Certificate of Appropriateness as
Described in the Attached Exhibit A.
WHEREAS, the Heritage Preservation Ordinance (Section 4-7-16) requires Heritage
Preservation Commission (HPC) approval of proposed alterations to designated potential
landmarks but only authorizes the HPC to do this upon submittal of an application for
permit; and
WHEREAS, a “certificate of appropriateness” is an application used by many cities with
heritage preservation programs. It allows an HPC to determine approval/denial as a step
in the process separate and ahead of submittal of building or land use permit submittals;
and
WHEREAS, the HPC has a draft ordinance to create a process using a certificate of
appropriateness; and
WHEREAS, a developer has approached Community Development about reusing and
modifying the Olmstead County Bank & Trust building; and
WHEREAS, Community Development would like to pilot the certificate of appropriateness
process on this project, prior to enacting the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that:
1. Approval of a pilot program to allow review and approval/denial of the concept plan
by the HPC as outlined in the attached Memorandum.
2. Extension of the period of review for landmark designation as required by the
ordinance due to the submittal of the demolition permit.

Pilot Program to Allow Review Under a Request for Certificate of Appropriateness

for Olmsted County Bank & Trust Building, 7 2Street SW, Rochester MN.
1. The property owner along with the developer will submit a request for Certificate of
Appropriateness, which would include a full set of project concept plans for review.
2. Submitted material will be reviewed and analyzed by the Heritage Preservation & Urban
Design Coordinator based on adopted standards of the Ordinance and provided to the
Heritage Preservation Commission (HPC).
3. The HPC would hold a public hearing and consider the proposed concept and city team
recommendation.
4. The HPC will determine approval/denial as a step in the process separate and ahead of
submittal of building or land use permit submittals.
5. The HPC may approve, approve with conditions or deny the requested certificate of
appropriateness, stating findings for the decision.
6. The HPC decision may be appealed to City Council by the applicant.
7. The developer will apply for building and any required land use permits as a separate
process.
8. Any submitted permit applications will be reviewed by City personnel for consistency with
the approved concept prior to the city issuance of permits. Any minor changes (as
determined by the Community Development Director) will be approved by the City team.
Any major changes to the plan will be brought to the HPC for additional review and
approval.
