RESOLUTION
Approving a Special Event Permit for Movies In The Park with Amplified Sound
Waiver.
WHEREAS, Sec. 8-11-1 of the Rochester Code of Ordinances (“R.C.O.”) defines a “Special
Event” as an event held in the city in which one of the following occurs:
a) Amplified sound is to be used;
b) A street, sidewalk, or other public way or place is closed for the benefit of
the event attendees;
c) A temporary alcoholic beverage license is required, or an existing on-sale alcoholic
beverage license is carried to the event location as part of a community festival; or
d) The event will adversely impact a considerable number of members of the public;
and,
WHEREAS, R.C.O. Sec 8-11-3 states: “ No person shall hold a special event unless such
person shall first obtain a permit to be issued by the council in the manner hereinafter
prescribed, and unless such person shall comply with the provisions of this chapter, and the
terms and conditions prescribed in such permit.”; and,
WHEREAS, R.C.O. Sec 8-11-6 (c) does empower the City Council to “waive the maximum
allowable sound pressure level provided in subsection (b) of this section and replace it with
a restriction requiring the amplified sound to terminate no later than 10:30 p.m. on the day
of each event covered by the permit.”; and,
WHEREAS, the Rochester Downtown Alliance wishes to hold an event named “Movies in
the Park” with movie showings at Central Park on six (6) dates: June 6, June 26, July 10,
July 24, August 14, and August 28, 2021. Each event begins at 6:00 p.m. and concludes at
10:00 p.m.; and,
WHEREAS, the Rochester Downtown Alliance requests that the City Council waives the 85
decibel limit for each event date, with all sound terminating no later than 10:30 p.m.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that the Council, pursuant to R.C.O. Sec. 8-11-3, does hereby approve the
Movies in the Park request for a special event permit.
BE IT FURTHER RESOLVED by the Common Council of the City of Rochester, Minnesota,
that the Council, pursuant to R.C.O. Sec. 8-11-6(c), does hereby waive the maximum
allowable sound pressure for the Movies in the Park event and replace it with a restriction
requiring the amplified sound to terminate no later than 10:30 p.m. on the dates of the event.
