RESOLUTION
Approving the Certificate of Appropriateness with One Condition for Property
Located at 7 Second St SW.
WHEREAS, The City Council, on May 24, 2021, approved a pilot program, allowing
property owner and developer (applicant) to submit a request for Certificate of
Appropriateness (COA), seeking approval of a renovations to 7 Second Street SW, a
designated potential landmark under City Code 4-7; and
WHEREAS, the Heritage Preservation Commission (HPC), on June 8, 2021, held a public
hearing and considered the application utilizing the Secretary of Interior Standards for the
Treatment of Historic Properties (the Standards) as required under City Code 4-7; and
WHEREAS, the HPC approved the requested COA and placed conditions that would
require the project to meet the standards; and
WHEREAS, the applicant submitted an appeal to the conditions of approval issued by the
HPC, seeking the removal of conditions and allowing the redevelopment project to be
constructed as originally submitted in their submitted COA; and
WHEREAS, The HPC, City teammates, and the City Council wish to see the proposed
project move forward and the adaptive reuse of this historic building occur, but with
modifications that meet the intent of the Standards to make the project design align more
closely with the intent of the Standards and preserve economic viability for the project;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that: The City Council hereby approves the COA for the development and construction of
the subject project up to and in accordance with the plans and designs submitted to the
HPC in connection with the June 8, 2021, special meeting, upon the condition that the
development team continues to work with the City team through a Type I approval process
to make the project design align more closely with the intent of the Standards and
preserve economic viability for the project.
