HomeMy WebLinkAboutOrdinance No. 4439 - Second Reading: Ordinance amendment relating to License, Permit and Investigation Fees ORDINANCE NO. ____ AN ORDINANCE AMENDING SECTION 5-12-2 OF CHAPTER 5-12, PARAGRAPH (b) OF SECTION 5-15-5 OF CHAPTER 5-15 AND PARAGRAPHS (a) AND (b) OF SECTION 8-10-5 OF CHAPTER 8- 10 OF THE ROCHESTER CODE OF ORDINANCES RELATING TO LICENSE, PERMIT AND INVESTIGATION FEES. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Section 5-12-2 of the Rochester Code of Ordinances is hereby amended to read as follows: Sec. 5-12-2. - Contents of application. No building shall be moved by a person until that person has obtained a permit from the council, upon written application therefor, in which shall be stated the present location of the building, the route of the moving, and the proposed new location of the same. The permit fee shall be $100.00 The fee for a permit shall be established as part of the fee schedule adopted by the Common Council. If said proposed new location complies with the zoning code, the permit shall be granted. The building shall then be moved along such route and at such time as may be specified by the police department. It shall be a specific condition of each permit that the holder thereof agrees to reimburse the city its actual cost, including all labor, including preinspection and surveillance, overhead and materials, of any required temporary removal and replacement, relocation or damage to, or destruction of, public property or facilities, occasioned by the building's move. Section 2. Paragraph (b) of Section 5-15-5 of the Rochester Code of Ordinances is hereby amended to read as follows Sec. 5-15-5. - License period, renewal and fees. (b) The license fee shall be $50.00 for a biennial massage therapist license with a $100.00 initial investigation fee. The license fee shall be $100.00 for the annual massage therapy business license with a $200.00 initial investigation fee. All required license fees shall be paid on a prorated quarterly basis. The fee for a license shall be established as part of the fee schedule adopted by the Common Council. 1 Section 3. Paragraphs (a) and (b) of Section 8-10-5 of the Rochester Code of Ordinances is hereby amended to read as follows: Sec. 8-10-5. - Investigation and license fees. (a) An organization applying for an initial premises permit or conducting lawful gambling at a site within the city shall be assessed an annual investigation fee of $250.00 as established as part of the fee schedule adopted by the Common Council and as permitted by Minn. Stats. § 349.16, subd. 8. (b) An organization conducting lawful gambling on five or fewer days in a calendar year and not awarding more than $50,000.00 in prizes for lawful gambling in a calendar year (exempt from state licensure pursuant to Minn. Stats. § 349.166, subd. 2) shall be assessed a license fee as established as part of the fee schedule adopted by the Common Council of $15.00 and as permitted by Minn. Stats. § 349.213, subd. 1. Section 4. This ordinance shall become effective as of the date of its publication.
