RESOLUTION
Approving Final Plat No. CD2021-0013PLAT, By Arcon Development, To Be
Known As Summit Pointe Seventh, For Development Consisting Of 16 Residential
Lots On 6.70 Acres, Located South of Summit Pointe Rd NW, North Of White Pine
Dr NW.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that after a hearing duly noticed and held on July 19, 2021, the following plat of lands in
Olmsted County, Minnesota are to be known and designated as follows:
That part of the Northwest Quarter of Section 8, Township 107
North, Range 14 West, Olmsted County, Minnesota, described
as follows:
Commencing at the southwest corner of Lot 2, Block 2,
SUMMIT POINTE SIXTH, according to the recorded plat
thereof (the next 7 courses are along the southerly and
westerly lines of said SUMMIT POINTE SIXTH); thence South
89 degrees 02 minutes 38 seconds East, assumed bearing,
90.95 feet; thence South 00 degrees 57 minutes 22 seconds
West, 23.99 feet for the point of beginning; thence South 76
degrees 44 minutes 39 seconds East, 582.59 feet; thence
South 13 degrees 15 minutes 21 seconds West, 55.00 feet;
thence South 76 degrees 44 minutes 39 seconds East,
228.00 feet; thence South 29 degrees 50 minutes 14 seconds
West, 170.65 feet; thence South 43 degrees 56 minutes 06
seconds West, 179.09 feet to the northerly line of SUMMIT
POINTE SECOND, according to the recorded plat thereof (the
next 6 courses are along said northerly line); thence South 87
degrees 57 minutes 22 seconds West, 142.13 feet; thence
North 74 degrees 02 minutes 38 seconds West, 264.49 feet;
thence South 15 degrees 57 minutes 22 seconds West,
123.62 feet; thence North 71 degrees 59 minutes 00 seconds
West, 13.13 feet; thence northwesterly 127.43 feet along a
tangential curve, concave southwesterly, central angle of 17
degrees 03 minutes 33 seconds, and a radius of 428.00 feet;
thence North 89 degrees 02 minutes 33 seconds West,
tangent to said curve, 8.23 feet to the westerly line of said
SUMMIT POINTE SECOND; thence North 00 degrees 57
minutes 22 seconds East, along the northerly extension of
said westerly line, 542.57 feet to the point of beginning.
Containing 6.70 acres, more or less.
TO BE KNOWN as “Summit Pointe Seventh,” submitted by Arcon Development,
Applicant is hereby approved, and all dedications of land or interests in land for public
purposes as shown on said plat are hereby accepted, subject to the following conditions:
1. Prior to recording the Final Plat the applicant must either record an executed
Boulevard Tree Green Facilities Agreement, or make a payment to the City Parks and
Recreation Department for the development’s boulevard tree obligation.
2. Parkland Dedication shall be met prior to recording the Final Plat.
3. The total requirement is .4582 acres, which includes deferred land from additions 1-
6, the amount required for this addition, and the credit for the trail corridor.
4. The Parks and Recreation Department recommends that dedication requirements be
met via grading .4582 acres of Outlot B of Summit Pointe Fifth to a 4% or less slope.
5. Outlot A from Summit Pointe Fourth and Outlot B from Summit Pointe Sixth should be
deeded to the City prior to recording. If the Rochester Public Works Department is not
ready for these outlots to be deeded to the City, a Park Easement should be created
and executed prior to recording.
6. A temporary, paved turn around will be required at the end of Summit Pine Road NW
when the road is constructed that is capable of supporting the weight of responding
fire apparatus.
7. An adequate water supply shall be provided for fire protection including hydrants
properly located and installed in accordance with the specifications of the Water
Division. Hydrants shall be in place prior to commencing building construction.
8. Streets and roadways shall be as provided in accordance with the fire code and the
Zoning Ordinance and Land Development Manual. Emergency vehicle access
roadways shall be serviceable prior to and during building construction.
9. All street, directional, and fire lane signs must be in place prior to occupancy of any
buildings. All buildings are required to display the proper street address number on
the building front, which is plainly visible and legible from the street fronting the
property. Number size must be a minimum 4” high on contrasting background when
located on the building. Reflective numbers are recommended.
10. Charges/fees applicable to the development of this Property are/will be addressed in
City-Owner Contract, and Development Agreement.
11. Ownership of the proposed Outlot A abutting Summit Pine Road NW needs to be
addressed to the satisfaction of the Rochester Public Works Department, prior to
recording the Final Plat.
12. The developer is obligated for the construction of the mid-block pedestrian path within
proposed Outlot B. Upon request, said Outlot B shall be deeded to the City at no cost
to the City.
13. Final Plat mylar must dedicate Outlot B as a utility easement.
