HomeMy WebLinkAboutResolution No. 170-21 - Resolution - MnDOT Variance Request for 65th St NW Reconstruction Projects RESOLUTION Authorizing the Request for a Variance from the Minnesota Department of Transportation (MnDOT) related to 65th St NW Reconstruction Projects. WHEREAS, the City of Rochester is preparing plans for 65th St NW between 60th Ave NW and 37th Avenue NW in the northwest area of the City of Rochester; and WHEREAS, the project includes the reconstruction of the roadway and the inclusion of a longitudinal off-road shared use path and an off-road shared use path crossing near a new Rochester Public School; and WHEREAS, Minnesota Rules for State Aid Operation 8820.9995 require that the Off- Road Shared Use Path be designed to accommodate a 20-mph design speed; and WHEREAS, the reasons for this variance requests are that as part of the shared use path crossing of 65th St NW, the horizontal curvature in one location on the north side of the box culvert crossing cannot accommodate the size of curve necessary to meet 20 mph due to constrained property conditions adjacent to the roadway; and the crest vertical curve located south of the box culvert crossing cannot accommodate the required vertical curve length to meet 20 mph, due to the grades needed to meet existing property edge conditions on both the north and south side of the roadway and due to the desire to have the shared use path also meet Americans with Disabilities Act requirements. NOW, THEREFORE BE IT RESOLVED, by the Common Council of the City of Rochester that the City requests a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9995 Minimum Off-Road and Shared Use Path Standards to allow: 1. A 50-foot Radius Horizontal Curve (16.5 MPH) north of the box culvert crossing in lieu of a 74-foot Radius Horizontal Curve (20 MPH). 2. A 30-foot Vertical Curve length (17.7 MPH) for the crest vertical curve south of the box culvert in lieu of the 85-foot Vertical Curve Length (20 MPH) for Algebraic Grade Difference of 3.05%. BE IT FURTHER RESOLVED, that the City indemnifies, saves and holds harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the reduced horizontal curve radius and vertical curve length in accordance with Minnesota Rules 8820.9995 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance.
