RESOLUTION
Approving a Conditional Use Permit, Restricted Development Final Plan No.
CD2021-021CUP, A Project Consisting of the Development of 141 Multi-Family
Dwelling Units, on a Total of 3.61 Acres Within a M-1 Zoning District, Located at
the Northeast Corner of Commerce Drive NW and Technology Drive NW.
WHEREAS, the project is being proposed through the Restricted Development Conditional
Use Permit process because the proposed development is not a permitted residential use
in the base zoning district.
WHEREAS, the Council adopts the Planning Commission findings as described attached to
the staff report dated August 12, 2021, and finds the proposal meets the regulations in
R.C.O. § 62.708 (subd. 3) Conditional Use Permit Restricted Development Final Plan.
WHEREAS, on August 12, 2021, the City of Rochester Planning Commission held a Public
Hearing on application, and recommended approval subject to conditions one through
seven proposed by the Planning Department.
WHEREAS, on August 30, 2021, the City of Rochester Common Council held a public
hearing to consider this application and adopted the findings of fact and approved the
application subject to conditions one through seven.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated seven conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Restricted
Development Final Plan No. CD2021-021 CUP requested by The Stencil Group, subject to
the conditions of approval shown below.
CONDITIONS
Final Development Plan with the following conditions:
1. An updated site/utility plan showing the following information:
a. The updated transformer location of the southwest side of the building
shall be submitted prior to the submittal of any building permits.
b. Bicycle parking for 16 bicycles.
c. Identify the location of trash storage on the site, which conforms to the R-3
district standards.
2. The development must comply with the R exterior lighting standard, as approved
at the Preliminary Plan stage.
3. A lot combination shall be recorded prior to the issuance of any building permits.
4. The proposed 20-foot water main utility easement shall be recorded prior to
issuance of any building permits.
5. Vacation of the 15ft drainage easement on the east side of the site, and
dedication of a new drainage easement, shall be recorded prior to the issuance
of any building permits.
6. Parkland dedication shall be met prior to issuance of any building permit
7. The boulevard tree requirement shall be met prior to issuance of any building
permits.
8. Grading & Drainage Plan approval is required for this application, as well as,
payment of any applicable Storm Water Management Area Charge for any
increase in impervious surface.
9. Execution of a City prepared City-Owner Contract and dedication of all applicable
public drainage and /or utility easement(s) is required prior to construction of
public infrastructure to serve this development.
10. Development is subject to a Plant Investment Fee (PIF) that is calculated and
collected as part of the Building Permit approval process.
