RESOLUTION
Approving Final Plat No. CD2021-0018PLAT, by Kurt Honetschlager, to be known
as Honetschlager First.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on September 20, 2021, the
following plat of lands in Olmsted County, Minnesota are to be known and designated as
follows:
That part of Lot 62, as monumented, AUDITOR'S PLAT "C"
according to the plat thereof on file at the County Recorder's
Office, Olmsted County, Minnesota described as follows:
Commencing at the northwest corner of said Lot 62; thence
South 00 degrees 38 minutes 05 seconds East (Note: All
bearings are in relationship with the Olmsted County
Coordinate System NAD 83', Adjusted 1996), along the west
line of said Lot 62, a distance of 972.75 feet to the POINT OF
BEGINNING; thence South 88 degrees 57 minutes 35
seconds East, 264.11 feet to the west line of the East 66.00
feet of said Lot 62; thence South 00 degrees 38 minutes 05
seconds East, along said west line, 336.44 feet to the south
line of said Lot 62 as monumented; thence North 89 degrees
39 minutes 56 seconds West, along said south line, 264.04
feet to a found three-quarter inch pipe at the southwest corner
of said Lot 62; thence North 00 degrees 38 minutes 05
seconds West along the west line of said Lot 62, a distance of
339.69 feet to the POINT OF BEGINNING.
TO BE KNOWN as “Honetschlager First”, submitted by Kurt Honetschlager, Applicant is
hereby approved, and all dedications of land or interests in land for public purposes as
shown on said plat are hereby accepted, subject to the following conditions:
1. The Final Plat shall be revised to identify flood areas and the Flood Protection
Elevation.
2. Prior to recordation of the final plat, the applicant shall obtain the appropriate permits
from Rochester Public Utilities and disconnect two of the water service lines to the
property, as identified in the RPU marked up plans attached to this report.
3. Prior to the recordation of the final plat, the applicant shall submit the park dedication
fee to the satisfaction of the Parks and Recreation Department.
4. Prior to recording the Final Plat, the applicant must either record an executed
Boulevard Tree Green Facilities Agreement, or make a payment to the City Park and
Recreation Department for the development’s boulevard tree obligation.
5. Grading and Drainage Plan approvals are required for individual lot development and
are required prior to issuance of any building permit.
6. The property is subject to a Utility Connection Agreement (Document No. A-1509961).
Additional fees will be applicable to proposed Lot 2 when developed.
7. The dwelling unit constructed on Lot 2 shall have a finished floor higher than the
adjacent regulatory flood plain.
8. If fill is required to ensure the dwelling is built to the regulatory flood protection
elevation the fill must extend on 15 feet around the structure. Should fill need to be
placed in the flood prone area, an application for Conditional Use Permit shall be
submitted to the City of Rochester.
