RESOLUTION
Approving Final Plat No. CD2021-021PLAT, by R & M Development, LLC, to be
known as Scenic Oaks West Second, for development consisting of 49 residential
lots and 3 outlots on 35.09 acres, located south of Riley Lane SW, west of Scenic
View Drive SW.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on October 18, 2021, the following
plat of lands in Olmsted County, Minnesota are to be known and designated as follows:
That part of the Southeast Quarter of the Southeast Quarter of Section 28
and that part of the Northeast Quarter of the Northeast Quarter of Section
33, all in Township 106 North, Range 14 West, Olmsted County, Minnesota,
described as follows:
Beginning at the southeast corner of said Southeast Quarter of the
Southeast Quarter of Section 28; thence on an assumed bearing of North
00°41’06” West, along the east line of said Southeast Quarter of the
Southeast Quarter, 304.43 feet to the southeast corner of Lot 15, Block 3,
SCENIC OAKS WEST FIRST, according to the recorded plat thereof on file
and of record at the office of the Olmsted County Recorder (the next 5
courses are along the south line of said plat of SCENIC OAKS WEST
FIRST); thence North 77°07’11” West 543.76 feet; thence South 24°13’40”
East 35.32 feet; thence South 65°46’20” West 56.00 feet; thence South
48°53’39” West 432.82 feet; thence North 82°21’23” West 434.79 feet to
the west line of said Southeast Quarter of the Southeast Quarter; thence
South 00°33’01” East 146.58 feet to the northwest corner of said Northeast
Quarter of the Northeast Quarter of Section 33; thence South 00°11’35”
West, along the east line of said Northeast Quarter of the Northeast Quarter,
887.24 feet; thence South 89°38’56” East 177.00 feet; thence South
00°21’04” West 90.01 feet; thence South 89°51’10” East 431.56 feet;
thence North 72°21’51” East 516.63 feet; thence North 17°38’09” West
54.64 feet; thence North 72°21’51” East 40.00 feet; thence South 89°45’29”
East 203.83 feet to the east line of said Northeast Quarter of the Northeast
Quarter; thence North 00°14’19” East, along said east line, 762.47 feet to
the point of beginning.
Containing 35.09 acres, more or less.
TO BE KNOWN as “Scenic Oaks West Second”, submitted by R & M Development, LLC.,
Applicant is hereby approved, and all dedications of land or interests in land for public
purposes as shown on said plat are hereby accepted, subject to the following conditions:
1. Execution of a Supplemental Development Agreement is required prior to the
recordation of a final plat.
2. Prior to recording the Final Plat, the applicant’s boulevard tree obligation shall
be met.
3. Prior to recording the Final Plat, the applicant’s parks dedication fee obligation
shall be met to the satisfaction of the Parks Department.
4. Owner shall execute a Supplemental Development Agreement, prior to
recording the Final Plat.
5. Charges/fees applicable to the development of this Property will be addressed
in City-Owner Contract, Development Agreement, and Supplemental
Agreement.
6. Prior to recording, the easements depicted within the Outlots on the Final Plat
shall be revised so they are consistent with the requirements of the
Supplemental Development Agreement for the Property.
7. The applicant shall comply with the Rochester Fire Department Memo, dated
September 29, 2021.
8. Any future additions, alterations, or development of this plat will need to be
reviewed for Fire Department Access at that time.
