RESOLUTION
Approving Final Plat No. CD2021-024PLAT, for the Consolidation of Two Existing
Parcels, to be known as The Lodge at Overland by TF Rochester, LLC.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on November 1, 2021, the following
plat of lands in Olmsted County, Minnesota are to be known and designated as follows:
That part of the East Half of the Southeast Quarter of Section 4, Township 107 North,
Range 14 West, Olmsted County, Minnesota, which lies southerly and westerly of
HIDDEN OAKS VALLEY.
ALSO:
That part of the Northeast Quarter of the Northeast Quarter of Section 9, Township 107
North, Range 14 West, Olmsted County, Minnesota, described as follows:
Commencing at the northeast corner of said Quarter Quarter Section; thence
South 88 degrees 41 minutes 11 seconds West, assumed bearing, along the
north line thereof, 713.79 feet to the northwest corner of Lot 6, Block 1,
OVERLAND POINTE for the point of beginning; thence continue South 88
degrees 41 minutes 11 seconds West along said north line, 596.18 feet to
the northeast corner of OUTLOT ‘B’, BANDEL NORTH FIRST; thence South
00 degrees 51 minutes 48 seconds East, along the east line thereof, 83.60
feet to the southeast thereof; thence South 70 degrees 00 minutes 00
seconds East 368.36 feet; thence easterly 203.08 feet along a tangential
curve, concave to the south, central angle of 15 degrees 18 minutes 35
seconds and a radius of 760.00 feet to the most westerly corner of Lot 7,
Block 1, OVERLAND POINTE (the next two courses are along the westerly
line of said OVERLAND POINTE); thence North 23 degrees 29 minutes 52
seconds East, 182.39 feet; thence North 01 degree 18 minutes 49 seconds
West, 150.00 feet to the point of beginning.
ALSO:
All that part of the Northwest Quarter of the Northeast Quarter, Section 9, Township
107 North, Range 14 West lying northerly of the northerly right-of-way line of
Overland Drive NW, EXCEPT Outlot B, Bandel North First, in the City of Rochester,
Olmsted County, Minnesota.
TO BE KNOWN as “The Lodge at Overland”, submitted by TF Rochester, LLC, Applicant
is hereby approved, and all dedications of land or interests in land for public purposes as
shown on said plat are hereby accepted, subject to the following conditions:
1. An updated Final Plat exhibit is required which identifies an additional utility
easement, which meets the requirements of RPU-Water.
2. Parkland dedication shall be required prior to recording of final plat to the
satisfaction of the Parks Department.
3. The boulevard tree requirement shall be met prior to issuance of building permits.
4. Payment of any applicable Storm Water Management Plan Area Charge
(SWMPAC) is required for this project prior to building permit approvals.
5. Execution of a City-Owner Contract is required prior to construction of public
infrastructure to serve this project. Any proposed public improvements lying within
Owners private property that are not within existing public easements will require
dedication of City prepared public easements prior to construction of the public
infrastructure.
6. To address the adequacy of public facilities for this proposed project, the Owner
shall enter into an Individual Site Development Agreement (ISDA) with the City that
shall replace the outdated Development Agreement as it pertains to the Property.
Execution of the ISDA shall occur prior to issuance of building permits for the
project.
7. Public Works related development charges and fees applicable to the development
of this Property, will be addressed in the ISDA, and will be invoiced as part of the
City Owner Contract process, or collected as part of the Building Permit.
8. RPU will require surveyed easements, centered on the actual primary
alignment/route after installation is complete.
9. The Owner will construct and maintain a temporary private sanitary sewer lift
station and force main facilitating initial connection of this project to the sanitary
sewer in Overland Drive NW. The temporary connection will remain until such time
gravity service is available to the Northwest Territories Trunk District. Terms and
conditions will be addressed in the ISDA.
