RESOLUTION
Approving Final Plat No. CD2021-032PLAT, To Be Known As Adamson Business
Park by Pat Adamson, To Replat 9.99 acres Into Thee Commercial Lots, Located
North of the Pennington Dr NW and E Frontage Rd Hwy 52 NW Intersection.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on Dec. 6, 2021, the following plat
of lands in Olmsted County, Minnesota are to be known and designated as follows:
Lot One (1), Block One (1), Pennington Business Park Second Subdivision, according to
the plat thereof on file at the County Recorder’s Office, Olmsted County, Minnesota, less
the following described parcel:
That part of Lot One (1), Block One of Pennington Business Park Second
Subdivision beginning at the Southwesterly corner of said Lot One (1), Block
One (1) of Pennington Business Park Second Subdivision beginning at the
Southwesterly corner of said Lot One (1); thence Northerly on an assumed
azimuth from North of 338°34'30" along the Westerly line of said Lot One
(1), a distance of 130.00 feet; thence Easterly 68°34'30" azimuth 287.35
feet; thence Southwesterly along a non-tangential curve, concave to the
Northwest having a radius of 200.00 feet, a central angle of 69°30'46" and
a chord azimuth of 213°49'07" along the Southeasterly line of said Lot One
(1) a distance of 100.00 feet to the point of beginning.
AND
That part of the Southeast Quarter of the Northeast Quarter and of the Northeaster
Quarter of the Southeast Quarter of Section 16, Township 107 North, Range 14 West,
Olmsted County, Minnesota described as follows:
Commencing at the northeast corner of said Southeast Quarter of the
Northeast Quarter; thence westerly on a Minnesota State Plane Grid
Azimuth from north of 268 degrees 11 minutes 10 seconds azimuth along
the north line of said Southeast Quarter of the Northeast Quarter 275.10
feet to the northwesterly corner of Cimarron Fifteenth, according to the plat
thereof on file at the County Recorder’s office, Olmsted County, Minnesota;
thence southerly 179 degrees 42 minutes 25 seconds azimuth along the
westerly line of Block 3 of said Cimarron Fifteenth and a southerly projection
thereof 1534.57 feet; thence westerly 269 degrees 42 minutes 25 seconds
azimuth 320.06 feet to the point of beginning; thence northwesterly 336
degrees 48 minutes 43 seconds azimuth809.76 feet; thence westerly 280
degrees 09 minutes 28 seconds azimuth 215.47 feet to the northeasterly
corner of Pennington Business Park Second Subdivision, according to the
plat thereof on file at the County Recorder's Office, Olmsted County,
Minnesota; thence southeasterly 156 degrees 48 minutes 43 seconds
azimuth along the easterly line of said Pennington Business Park Second
Subdivision 889.64 feet to the northerly corner of Block 3,Pennington
Business Park Sixth Subdivision, according to the plat thereof on file at the
County Recorder's office, Olmsted County, Minnesota; thence easterly 78
degrees 54 minutes 12 seconds azimuth along the northerly line of said
Block 3 and an easterly projection thereof 184.08 feet to the point of
beginning. Said tract contains 3.51 acres more or less.
Containing 9.99 acres, more or less.
TO BE KNOWN as “Adamson Business Park”, submitted by Pat Adamson, Applicant is
hereby approved, and all dedications of land or interests in land for public purposes as
shown on said plat are hereby accepted, subject to the following conditions:
1. A revised Final Plat exhibit shall be submitted prior to Final Plat recording which
modifies the proposed drainage easement to include public utilities to the
satisfaction of Rochester Public Utilities – Operations Division.
2. Prior to recording the Final Plat, the applicant must either record an executed
Boulevard Tree Green Facilities Agreement, or make a payment to the City Park
and Recreation Department for the development’s boulevard tree obligation.
3. Prior to recording the Final Plat, a private Utility Services Agreement/Easement
shall be recorded to memorialize the portion of sanitary sewer located on the
proposed Lot 1, to the satisfaction of Rochester Public Works.
4. Prior to recording the Final Plat, the developer shall provide the Community
Development Department with proof of a recorded cross access agreement
between Lots 1 and 2 and Lots 2 and 3.
