RESOLUTION
Approving Conditional Use Permit No. CD2021-032CUP, For The Construction Of
A One Story Loading Dock On 0.79 Acres, Located On The East Side Of 1st Ave
NW, Between 1st St NW And West Center St.
WHEREAS, the project is being proposed through the Conditional Use Permit process
because proposed “Parking Facilities” in the Central Business District require approval of
the City Council; and,
WHEREAS, the proposal is consistent with Land Development Manual, Destination Medical
Center Design Guidelines and City of Rochester Downtown Master Plan.
WHEREAS, the Council adopts staff findings as described in the staff report dated Dec. 8,
2021, and finds the proposal meets the regulations in R.C.O. § 61.146 Conditional Use
Permit.
WHEREAS, on Dec. 8, 2021, the City of Rochester Planning Commission considered this
application, and adopted the findings of fact and recommended approval subject to
conditions one through ten proposed by the Planning Department.
WHEREAS, on Dec. 13, 2021, the City of Rochester Common Council held a public hearing
to consider this application and adopted the findings of fact and approved the application
subject to conditions one through ten.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated ten conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit No. CD2021-
032CUP, requested by the Mayo Clinic, subject to the conditions of approval shown below.
CONDITIONS
1. Prior to building permit, the applicant shall provide: a) a revised Site Plan which
identifies the dimension of clear pedestrian path along 1st Ave NW and Center
St West; and b) a revised landscaping plan reflecting updated landscaping
materials and design along 1st Ave NW based on the required clearance from
the RPU Utility sectional duct.
2. Prior to issuance of building permits, a staging site plan shall be submitted to
Community Development.
3. The boulevard tree plantings requirements for all streets shall be met prior to the
issuance of a Temporary Certificate of Occupancy, subject to locations reflected
in the staging plan.
4. A Final Certificate of Occupancy will not be issued until the entire site plan/
landscape plan is constructed, including the temporary pocket park on the south
side of the site.
5. The temporary pocket park shall be installed within one year of completion of the
Jacobson Building Expansion and shall remain until the site is redeveloped. The
temporary pocket park shall not prevent future redevelopment of the site.
6. Grading & Drainage Plan shall be approved prior to the approval of building
permit plans.
7. A revocable permit is required for all private improvements and amenities located
in the right-of-way.
8. Development of this project is subject of a Water Availability Charge and a Trunk
Sewer District Charge for the East Zumbro Silver Creek Subdistrict, to the
satisfaction of the Public Works Department. Obligations will be invoiced and
shall be paid within 30 days of invoicing.
9. This development is subject to a Plant Investment Fee that is calculated and
collected as part of the Building Permit approval process.
10. A minimum of three feet of clearance shall be provided from the existing
Rochester Public Utility sectional duct location to any structural soil excavation
or tree planting.
