HomeMy WebLinkAboutResolution No. 055-22 - Resolution - Rochester Pride - Community Festival RESOLUTION Approving a Special Event Permit for Rochester Pride 2022 Community Festival with Amplified Sound Waiver. WHEREAS, Sec. 5-19-5(b) of the Rochester Code of Ordinances (“R.C.O.”) states that specified on-sale intoxicating liquor licensees may dispense intoxicating liquor off-premises at a Community Festival held with the City of Rochester; and WHEREAS, R.C.O. Sec. 5-19-5(b) defines a “Community Festival” to mean a community event celebrating the people, history, food, culture, music or events of the City of Rochester as declared by resolution of the Common Council; and WHEREAS, R.C.O Sec 8-11-6 (c) does empower the City Council to “waive the maximum allowable sound pressure level provided in subsection (b) of this section and replace it with a restriction requiring the amplified sound to terminate no later than 08:00 p.m. on the day of each event covered by the permit.”; and WHEREAS, the Rochester Pride 2022 (“The Event”) event will occur on May 21, 2022, on the track field area of the Soldier’s Field Park located at 300 7th St SW; and WHEREAS The Event is a community event celebrating the people, history, food, culture, music, or events of the City of Rochester; and WHEREAS, the City of Rochester Common Council wishes to declare The Event as a Community Festival. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the Council, pursuant to R.C.O. Sec. 5-19-5(b), does hereby declare the Rochester Pride Event as a Community Festival. BE IT FURTHER RESOLVED by the Common Council of the City of Rochester, Minnesota, that the Council, pursuant to R.C.O. Sec. 8-11-6(c), does hereby waive the maximum allowable sound pressure The Event and replace it with a restriction requiring the amplified sound to terminate no later than 08:00 p.m. on the dates of the event. BE IT FURTHER RESOLVED by the Common Council of the City of Rochester, Minnesota, that the Council, pursuant to Council Resolution 176-21 passed at the August 19, 2021, emergency meeting, strongly recommends that the event operator follow current and changing CDC guidelines and consider incorporating COVID-19 mitigation efforts to make their event as safe as possible.
