HomeMy WebLinkAboutResolution No. 070-22 - Resolution - 2022-24 CBA Rochester Inspectors Association RESOLUTION Approving the 2022-24 Collective Bargaining Agreement with the Rochester In- spectors’ Association. WHEREAS, the Rochester Inspectors’ Association, Community Development Depart- ment (the “Association”), and the City of Rochester are parties to an existing Collective Bargaining Agreement that expired on December 31, 2021; and WHEREAS, representatives of the Association and representatives of the City of Roch- ester have negotiated a three-year Collective Bargaining Agreement (CBA) for the term of January 1, 2022, through December 31, 2024; and WHEREAS, Attachment A summarizes the changes negotiated to the existing CBA be- tween the parties. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Roches- ter, Minnesota, that the City approves and ratifies the attached changes and the 2022- 2024 CBA with the Rochester Inspectors’ Association. Article 2, Recognition, modify as follows to reflect the evolution of the Community De- velopment Department; change title of labor contract to reflect “Community Develop- ment Department” rather than the Building Safety Department (reflects organizational restructure); replace all references in the contract to the Director of Building Safety with the “Community Development Director” and references to Building Safety Depart- ment with Community Development Department: RECOGNITION The City recognizes the Association as the exclusive representative for all inspectors and chief inspectors in the Community Development Department, except supervisors, clerical employees, all other exempt employees, and those not meeting the definition of public employees as defined by the Public Employment Labor Relations Act, Minnesota Statute 179A. 2. Article 10, Unused Sick Leave, add a clarifying introductory paragraph as follows: To qualify for any provision of this Article, Unused Sick Leave, the employee must be an active employee who has accrued ten (10) or more years of continuous full-time or part-time regular service with the City of Rochester. 3. Article 15, Wages, modify dates in this Article to reflect a new three-year contract for 2022-24; update Addendum A, Wages, to reflect a 2.75 percent increase for 2022 and a 2.0 percent increase both in 2023 and 2024; increases are effective the first full pay period in January of each contract year. 5. Article 21, Safety, Section A, modify as follows: The City will reimburse all employees covered by this Agreement who are required to wear safety shoes, up to a maximum of four hundred seventy-five dollars ($475.00) over the three-year term of this Agreement for the purchase of safety shoes. An employee may be reimbursed for the cost of the shoes, but shall not exceed the maximum allowable amount for the term of this Agreement. Employees will only be eligible for this allowance when the original receipt for the shoes is submitted for reimbursement. 6. Article 22, Term, modify language to reflect a three-year contract for 2022-24. This Agreement shall be in effect from January 1, 2022 and shall remain in effect until December 31, 2024, and from year to year thereafter, unless either party shall notify the other in writing by May 1, 2024 that it desires to modify or terminate this Agreement. 7. Signature Page, update with correct names for City Clerk and bargaining unit repre- sentatives. 8. MOU, Recognition Clause, delete as the fire inspector was placed in the IAFF bar- gaining unit per a BMS unit clarification ruling. 9. Agree to other minor language changes, clarification, and/or corrections: the Inspec- tors’ Association will review all edits prior to executing the contract. 3
