RESOLUTION
Authorizing execution of the Collective Bargaining Agreement with Law Enforce-
ment Labor Services, Inc., Local 194 (Union), Police Officers, for the calendar
years of 2022-24.
WHEREAS, the Union and the City of Rochester are parties to an existing Collective
Bargaining Agreement that expired on December 31, 2021; and
WHEREAS, representatives of the Union and representatives of the City of Rochester
have negotiated a three-year Collective Bargaining Agreement (CBA) for the term of Jan-
uary 1, 2022, through December 31, 2024; and
WHEREAS, “Attachment A” below summarizes the changes negotiated to the existing
CBA between the parties.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Roches-
ter, Minnesota, that the Council approves and ratifies the 2022-2024 CBA with Law En-
forcement Labor Services, Inc., Local 194 with the attached changes incorporated.

1. Article, 2, Definitions, delete definition of “gender”; update corresponding references
in the contract.
GENDER means the term “he” or “his” as found in this document are utilized for the sake
of brevity and are not meant to imply the exclusion of other genders within the work force
or discrimination on the part of either party to this Agreement.
2. Article 6, Grievance Procedure, modify the language as follows:
Step 5. A grievance unresolved in Step 3 or Step 4, will be submitted to arbitration
subject to the provisions of the Public Employment Labor Relations Act of 1971 as
amended. The selection of an arbitrator will be made in accordance with the “Rules
Governing the Arbitration of Grievances” as established by the Bureau of Mediation Ser-
vices. However, a grievance arbitration for written disciplinary action, discharge, or ter-
mination shall include the arbitrator selection procedures established in Minnesota Stat-
ute 626.892.
3. Article 8, Hours of Work, Section I

I. By October 15 of each year, an Officer may choose to sell back up to sixty

(60) hours of accrued compensatory time with a payout in the second (2) pay
period in November. Any compensatory time hours sold back will be removed
from the Officer’s compensatory time balance. RPD leadership will prepare
and disseminate a compensatory time sell-back document for Officers to com-

plete. In 2023 only, by August 15 of each year, an Officer may choose to sell
back up to sixty (60) hours of accrued compensatory time with a payout in the

second (2) pay period in September.
4. Article 10, Holidays, Columbus Day, delete.
A. Employees shall receive four point six one five (4.615) four point two three one
(4.231) hours, in lieu of the holiday, added to their vacation time each pay period.
The amount of time added shall not exceed one hundred twenty (120) one hun-
dred ten (110) hours per year (ten \[10\] hours per the eleven \[11\] twelve \[12\] holi-
days observed).
B. Holidays to be observed will be:

Non-shift employees will follow the City’s holiday calendar utilized for employees
working a Monday through Friday work schedule.
C. Any employee required to work on the following holidays: Martin Luther King's
Birthday, President's Day, Memorial Day, Independence Day, Labor Day, Colum-
bus Day, Veteran's Day, Thanksgiving Day, Day after Thanksgiving, Christmas
Eve Day, Christmas Day, and New Year's Day will receive time and one-half (1
½) pay for that day.
5. Article 14, Insurances, first section referencing 2019 timeframe for Sections A through
F should be deleted as this is obsolete information; modify the second Section B to
eliminate the reference to the high-deductible medical option and all related language
references to the Health Savings Account contributions (per previously agreed upon
MOU), and modify the City’s monthly premium contribution to the base option as fol-
lows:

6. Article 19, Wages

Effective the first (1) full pay period in January of each contract year, the following
increases will be applied across the board to all Officer pay rates: two and three-quar-
ters (2.75%) in 2019; two and one-half percent (2.5%) in 2020; two and one-half per-
cent (2.5%) in 2021 two and three-quarters percent (2.75%) in 2022; two percent
(2.0%) in 2023; two percent (2.0%) in 2024.
A one-time lump sum payment in the amount of $1,500 shall be paid to employees in
active payroll status and on Step K as of December 31, 2022. Said lump sum payment
shall be paid in January 2023.
Step adjustment shall be administered on each Officer’s anniversary date, and Offic-
ers will advance to the step commensurate with their years of service as a Police
Officer with the City. In October 2023, Officers will advance one bonus step.
Effective January 1, 2024, the step progression shall be modified as noted below:
Steps Min, B (1/+1), C (2/+1), D (3/+1), E (4/+1), F (5/+1), G (6/+1) H 8, I 10, J 12 and
K 14 shall be changed to read: Steps Min, B (Min+1), C (B+1), D (C+1), E (D+1) F
(E+1), G (F+1), H (G+2), I (H+2), J (I+2) and K (J+2).
A one-time lump sum payment in the amount of $1,000 shall be paid to employees in
active payroll status and on Step K as of December 31, 2024. Said lump sum payment
shall be paid in January 2025.
7. Article 20, Police Training Officer
Officers who have had additional training and who are assigned as a Police Training
Officer (PTO) to work with new Officers or Officers who may require additional training
will be paid two hundred forty-five dollar and forty-eight cents ($245.48) per month in
addition to their regular wages (one hundred thirteen dollars and thirty cents $113.30\]
per pay period or any fraction thereof.) Effective the first full pay period following full
execution of this Agreement, the Police Training Officer payment will increase to one
hundred thirty dollars ($130) per pay period, one hundred thirty five dollars ($135) per
pay period in 2023 and one hundred forty dollars ($140) per pay period in 2024. There
should be no more than three (3) Police Training Officers assigned to any one (1) new
recruit.
8. Article 33, Term of Agreement.
This Agreement shall be in effect from January 1, 2019 2022 and shall remain in effect
until December 31, 2021 2024, and from year to year thereafter, unless either party
shall notify the other in writing by May 1, 2021 2024, that it desires to modify or termi-
nate this Agreement. The terms of the Wage Article and Insurance Article shall be

retroactive to January 1, 2022 and limited to those employees who are in active payroll
status as of the date of the full execution of this Agreement.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF ROCHESTER AND
LAW ENFORCEMENT LABOR SERVICES, INC., LOCAL 194
MASTER PATROL OFFICER PROGRAM
This Memorandum of Understanding is entered into between the City of Rochester, Min-
nesota, (hereafter “City”) and Law Enforcement Labor Services, Inc., Local 194, (hereaf-
ter “Union”).
WHEREAS, the City and the Union are parties to a Collective Bargaining Agreement
(CBA), in effect from January 1, 2019 2022 through December 31, 2021 2024.
WHEREAS, the parties have discussed the creation of a Master Patrol Officer Program
on a pilot program basis.
NOW, THEREFORE, the parties agree as follows:
1. The Master Patrol Officer assignment is intended to recognize those officers who have
demonstrated leadership, superior job knowledge and proficiency, and a willingness
to develop, mentor and coach other officers. The Chief shall establish and post the
criteria for participation, eligibility, performance expectations and assignment to the
Master Patrol Officer Program.
2. Effective the first day of the first full pay period following ratification of the 2019-2021
2022-2024 CBA, this Memorandum of Understanding shall replace Article 19 Wages,
paragraph 4, which states:
Officers meeting the certification criteria and performance expectations established by
the Chief of Police for senior Officer assignment pay shall receive an additional fifty

cents ($.50) per hour effective the first (1) full pay period in January 2017 and one

dollar ($1.00) per hour effective the first (1) full pay period in January 2018. It is the
understanding of both the Union and the City that this special assignment pay will be
granted to no more than approximately twenty five percent (25%) of the RPD licensed
peace Officers.
3. Employee assigned to the Master Patrol Officer Program shall receive additional pay
as follows:
Effective first day of first full pay period following ratification of CBA $1.502.00
per hour
Effective first full pay period in January 2020 $1.75
Effective first full pay period in January 2021 $2.00
4. Participation in the Master Patrol Officer Program and assignment as a Master Patrol

Officer will be granted to no more than twenty percent (20%) of the bargaining unit. No
employee shall receive Master Patrol Officer pay while receiving other Specialty Unit
pay.
5. This Memorandum of Agreement shall sunset effective December 31, 2021 2024, with
the exception of paragraph No. 6 which continues in effect after December 31, 2021
2024.
6. Upon the sunset and expiration of this Memorandum of Agreement on December 31,
2021 2024, Article 19 Wages, paragraph 4 5 shall be included read as follows:
Officers meeting the criteria and performance expectations established by the Chief
of Police for Senior Officer assignment pay shall receive an additional one dollar
($1.00) per hour. It is the understanding of both the Union and the City that this
special assignment pay will be granted to no more than approximately twenty percent
(20%) of the bargaining unit. No employee shall receive Senior Officer assignment
pay while receiving other Specialty Unit pay.
7. This Memorandum of Understanding constitutes the full and complete understanding
between the parties regarding this matter.
