RESOLUTION
Approving Final Plat No. CD2022-005PLAT by 988 Rochester, LLC, to be known
as City Walk Rochester Subdivision, for the consolidation of 4 lots and vacated
right-of-way, encompassing a total of 0.78 acres located at the southwest corner
of 2nd St SW and 6th Ave SW.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on May 16th, 2022, the following
plat of lands in Olmsted County, Minnesota are to be known and designated as follows:
Lots 5, 6, 7, and 8, Block 15, HEAD AND McMAHON'S ADDITION,
according to the plat thereof on file at the County Recorder's Office, Olmsted
County, Minnesota.
AND
That part of the 18.00 feet wide public alley in Block 15 of HEAD AND
McMAHON'S ADDITION, according to the plat thereof on file at the County
Recorder's Office, Olmsted County, Minnesota, lying north of the easterly
extension of the south line of Lot 4 of said Block 15.
TO BE KNOWN as “CITYWALK ROCHESTER SUBDIVISION”, submitted by 988
Rochester, LLC, Applicant is hereby approved, and all dedications of land or interests in
land for public purposes as shown on said plat are hereby accepted, subject to the
following conditions:
1. Final plat GIS impact and E911 fees are required prior to Final Plat recording
2. Alleyway vacation CD2022-002VAC, shall be recorded prior to Final Plat
recording.
3. The applicant’s Boulevard Tree obligation shall be met prior to the issuance of
building permits
4. Execution of a City prepared Revocable Permit Agreement is required for all
private encroachments including landscaping and private amenities within the
public ROW or easements, approved as part of this CUP.
5. Execution of a City-Owner Contract will be required for all public improvements
constructed for this proposed redevelopment, as well as, for reconstruction of any
existing public infrastructure within the public ROW or easements.
6. Development charges/fees applicable to the redevelopment of this property shall
be paid prior to the issuance of utility connection permits, or at the City’s discretion,
within 30 days after.
7. Grading & Drainage Plan shall be approved prior to the approval of building permit
plans.
