HomeMy WebLinkAboutResolution No. 138-22 - Resolution - Education Center Second CD20022-010PLAT RESOLUTION Approving Final Plat No. CD2022-010PLAT, To Be Known As Education Center Second, by 1922 Development, LLC., for the Subdivision of One 2 acre Platted Lot Into Two Separate Lots, Located on the South Side of Jeremiah Ln NW, North of 19th St NW, Approximately 300 Feet East of 32nd Ave NW. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on June 6, 2022, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: Lot 5, Block 1, EDUCATION CENTER SUBDIVISION, according to the plat thereof on file at the County Recorder's Office, Olmsted County, Minnesota. TO BE KNOWN as “Education Center Second”, submitted by 1922 Development, LLC., Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to recording the Final Plat, a revised plat exhibit shall be provided to Community Development with the following information: a. The shown access easement adjacent to Jeremiah Lane NW on Lot 2 shall also be additionally identified as a Public Utility Easement, to the satisfaction of Rochester Public Utilities; b. A Water Main Utility Easement shall be shown on Lot 2, or established on a separate instrument to the satisfaction of Rochester Public Utilities; c. A private access easement connecting Lots 1 and 2, as well as Lot 1 to Jeremiah Lane NW, shall be identified to the satisfaction of the Community Development Team. 2. Prior to Final Plat recording, a separate instrument establishing a private access easement connecting Lots 1 and 2, as well as Lot 1 to Jeremiah Lane NW shall be recorded to ensure pedestrian connectivity through the entire site once the subdivision occurs. Said easement shall be documented on the final plat mylar. 3. Prior to recording the Final Plat, the applicant must either record an executed Boulevard Tree Green Facilities Agreement, or make a payment to the City Park and Recreation Department for the development’s boulevard tree obligation. 4. Grading and Drainage Plan approvals are required for individual lot development and are required prior to issuance of any building permit. 5. A separate instrument for private utility easement and maintenance agreement for utilities crossing lot 2 to serve lot 1, to the satisfaction of Rochester Public Utilities, shall be recorded prior to or concurrently with the subject Final Plat. 6. Prior to Final Plat recording, applicant shall provide a revised Traffic Impact Study that will address the additional development intensity of the lot, which is subject to the review and approval of the Public Works Department.
