HomeMy WebLinkAboutResolution No. 139-22 - Resolution - Preserve at West Circle CD2022-012PLAT RESOLUTION Approving Final Plat No. CD2022-012PLAT, To Be Known As The Preserve at West Circle, by by Michael Zirbes, to Plat a 55.11-Acre Parcel Into 118 Residential Lots and Seven Outlots, North of 19th Street NW and East of Ashland Drive NW. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on June 6, 2022, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: The west half of the Northeast Quarter, Section 29, Township 107 North, Range 14 west, excluding those parts platted as Circle 19 Plaza First Replat, Circle 19 Plaza Second, Nans Legacy, and Superior Ridge Townhomes Replat CIC 207, Olmsted County, Minnesota. TO BE KNOWN as “The Preserve at West Circle”, submitted by Michael Zirbes of Preserve at West Circle, LLC., Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to recording the Final Plat, a revised Final Plat exhibit shall be provided to Community Development with the following revisions: a. All instances of labeling “Superior Drive NW” shall be relabeled to ”Superior Lane NW” b. All instances of labeling “Preserve Drive” shall be relabeled to ”Preserve Drive NW” c. On sheet 2, a road is mislabeled; “Hartland Drive NW” shall be corrected to “Heritage Place NW”. d. Flood Zone AE, located within Outlot A, shall be delineated on the final plat. 2. The developer shall execute and submit a restrictive covenant to the Community Development Department identifying that the floodplain area be left essentially in the state shown on the plat that will be recorded concurrently with the Final Plat. 3. Prior to recording the Final Plat, the applicant shall meet Parkland Dedication requirements, via cash in lieu of land, to the satisfaction of the Parks and Recreation Department. 4. Prior to recording the Final Plat, the applicant shall either make a payment to the Rochester Park and Recreation Department to plant the required number of boulevard trees, or execute and record a Boulevard Tree Green Facilities agreement, which will include a planting plan approved by the Parks Department. 5. The applicant shall comply with the Rochester Fire Department Memo, dated May 20, 2022. 6. Hydrants properly located and installed in accordance with the specifications of the Water Division shall be in place prior to commencing building construction. 7. Emergency vehicle access roadways shall be serviceable prior to and during building construction.
