RESOLUTION
Approving Final Plat No. CD2022-015PLAT, To Be Known As Northwest
Commercial Center Ninth, by Arnett Enterprises, LLC., for the Subdivision of One
15.05 Acre Lot Into Two Lots and One Outlot, Located on the Northeast Intersection
of Scott Road NW and Commerce Drive NW.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on June 20, 2022, the following plat
of lands in Olmsted County, Minnesota are to be known and designated as follows:
Lot 2, Block 1, NORTHWEST COMMERCIAL CENTER FIFTH, according to the plat
thereof on file at the County Recorder’s Office, Olmsted County, Minnesota.
TO BE KNOWN as “Northwest Commercial Cent Ninth”, submitted byArnett Enterprises,
LLC., Applicant, is hereby approved, and all dedications of land or interests in land for
public purposes as shown on said plat are hereby accepted, subject to the following
conditions:
1. A revised Final Plat exhibit shall include a 20-feet wide Water Main Utility
Easement, extended northward from the existing utility easement along the
eastern boundary of proposed Lot 2-Block 1.
2. A traffic impact study will be required for any future zoning map amendments or
site development applications impacting these properties.
3. The applicant’s boulevard tree obligation shall be met prior to issuance of a
building permit.
4. A Development Agreement has been executed for this Property and individual lot
development is subject to the terms of the Agreement.
5. The applicant shall comply with the Rochester Fire Department Memo, dated June
3, 2022.
