RESOLUTION
Approving Final Plat No. CD2022-021PLAT, To Be Known As John Hardys Replat,
To Adjust The Lot Lines On Three Existing Commercial Lots, Located On The
North Side of 7th St NW, West of Hwy 52.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on July 18, 2022, the following plat
of lands in Olmsted County, Minnesota are to be known and designated as follows:
The West 67.5 feet of Lot 5, Block 1, Hall's Second Addition, Rochester, Minnesota,
except the North 65.00 feet thereof. Also the East 10 feet of Lot 4, Block 1, Hall's Second
Addition, Rochester, Minnesota, except for the North 65 feet thereof.
AND
All of Lot Five (5), Block One (1), Hall's Second Addition, in the City of Rochester, less
the North 65.00 feet thereof and less the West 67.50 feet thereof, Olmsted County,
Minnesota.
AND
The North 65 feet of Lot 5, Block 1, Hall's Second Subdivision, in the City of Rochester,
Olmsted County, Minnesota.
AND
Beginning at the Northeast corner of Lot Five (5), Block One (1), Hall's Second Addition,
Rochester, Minnesota; thence North 89 degrees 00 minutes 20 seconds West, assumed
bearing, along the North line of said Lot Five (5) a distance of 237.85 feet to the Northwest
corner of said Lot Five (5); thence North, along the East line of Lot Three (3) in Block One
(1) a distance of 30.00 feet; thence South 89 degrees 00 minutes 20 seconds East, 237.85
feet to the
East line of said Northwest Quarter; thence South, along said East line, 30.00 feet to the
point of beginning.
TO BE KNOWN as “John Hardys Replat”, is hereby approved, and all dedications of land
or interests in land for public purposes as shown on said plat are hereby accepted, subject
to the following conditions:
1. Prior to Recordation of the Final Plat, the applicant’s boulevard tree obligation shall
be met.
2. Prior to Recordation of the Final Plat, the applicant shall submit a Final Plat exhibit
that accurately indicates adjacent ROW.
3. Prior to Recordation of the Final Plat, the applicant shall submit all GIS impact and
E911 addressing fees as required by the Olmsted County Planning.
4. Prior to Recordation of the Final Plat, the applicant shall Draft and Record an
Agreement, approved by Rochester Public Works and Rochester Public Utilities,
that identifies the requirements of future water main extension between the lots.
5. Prior to Recordation of the Final Plat, an exhibit confirming that proposed Lots 1
and 2 will meet zoning standards related to Floor Area Ratio and Landscape Area
shall be provided to Community Development.
6. Prior to Recordation of the Final Plat, cross access and cross parking agreements
between proposed Lots 1 and 2 shall be recorded.
