HomeMy WebLinkAboutResolution No. 171-22 - Resolution - CD2022-005CUP KAMRT-AMPI Parking Facility RESOLUTION Approving Conditional Use Permit No. CD2022-05CUP, For the Second Phase of a Surface Parking Lot, To Be Known As KMART/AMPI Parking Facility, Consisting of 642 Additional Parking Stalls, Located on 23.96 Acres of Property, Located North of 9th St SE, Between Broadway Ave S and 3rd Ave SE. WHEREAS, the project is being proposed through the Conditional Use Permit process because proposed “Parking Facilities” in the Transportation Oriented District (TOD) require approval of the City Council; and, WHEREAS, the proposal is consistent with Land Development Manual, and Downtown Parking Overlay Zone (DPOZ); and, WHEREAS, the Council adopts staff findings as described in the revised staff report dated July 6, 2022, as the proposal meets the regulations in R.C.O. § 61.146 Conditional Use Permit; and WHEREAS, on June 22, 2022, the City of Rochester Planning Commission considered this application, and adopted staff findings and recommended approval subject to conditions one through seven proposed by the Planning Department. WHEREAS, on July 18, 2022, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to conditions one through six. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated ten conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit No. CD2022- 005CUP, requested by Camegaran, LLC., subject to the six conditions of approval shown below. CONDITIONS 1. The Minnesota Geological survey monitoring well on site will either need to be sealed, converted to an “at-grade”, or provided protective barriers around the wellhead. 2. The applicant shall submit construction plans to Rochester Public Utilities showing hydrant relocations, and unused private water service disconnections. 3. A 20' Water Main Utility Easement MUE shall be provided at all future relocations of public water main lines and hydrants. 4. Prior to building demolition, any unused water meters shall be returned to Rochester Public Utilities. 5. Prior to occupancy of the parking facility, the former K-mart and AMPI properties shall be combined into one single parcel through the approval and recording of a final plat. 62 6. The development shall provide ADA Accessible parking spaces and features in accordance with the Minnesota State Building Code.
