(a) Ordinance - Amendments related to the General Functions of the Public Works Department ORDINANCE NO. ____ AN ORDINANCE AMENDING SECTION 2-14-2 OF CHAPTER 2-14 OF TITLE 2 OF THE ROCHESTER CODE OF ORDINANCES RELATING TO GENERAL FUNCTIONS AND AMENDING CLAUSE (5) OF PARAGRAPH (a) OF SECTION 9-7-3 OF CHAPTER 9-7 OF TITLE 9 OF THE ROCHESTER CODE OF ORDINANCES RELATING TO GENERAL PROVISIONS THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Section 2-14-2 of Chapter 2-14 of the Rochester Code of Ordinances is hereby amended to read as follows: Sec. 2-14-2. – General functions. The public works department shall have the following functions and duties: (1) Conduct engineering studies and maintain all engineering records and documents of the city, and provide technical engineering advice and service to all city departments, divisions, offices, boards, commissions and agencies as directed by the council. (2) Design and inspect all city construction projects and review all engineering work done by consultants for the city to ensure that the best interests of the city are met. (3) Conduct traffic studies, and based thereon, design, install and maintain all traffic signals, signs and devices. (4) Sweep, flush and keep all city streets and sidewalks free from snow, ice and debris. (5) Build, surface, rebuild, patch, stripe, and in any other way which may be required, maintain all city streets, alleys, sidewalks, curbs, gutters and public ways. (6) Build and maintain all sanitary and storm sewers. (7) Treat and dispose of all sewage collected through the city sewer system. (8) Operate and maintain a sanitary landfill site for the disposal of garbage, refuse and trash. (9) Operate a public weigh station and dispense gasoline to all authorized vehicles. 1 (10) Issue permits, conduct studies from time to time and perform such other duties and functions as the council may provide. Section 2. Clause 5 of Paragraph (a) of Section 9-7-3 of Chapter 9-7 of the Rochester Code of Ordinances is hereby amended to read as follows: Sec. 9-7-3. – General provisions. (a) No unattended newspaper or periodical dispensing device shall be placed: (1) Within six feet of any fire hydrant or fire alarm box or attached in any manner to any fire alarm box shaft, ornamental street light pole, traffic signal, parking meter or any traffic control device post; (2) Where it projects beyond any curbline onto the roadway; (3) Within three feet of any marked crosswalk; (4) Within three feet of any curb return at any intersection; (5) Within three feet of the curb return of any driveway approach; (6) Within three feet of the approach to any sign marking a designated bus stop, or any designated loading space or three feet forward of such sign; (7) Where it restricts access to a bus shelter or a bus bench; (8) Where it interferes with the front and rear doors of buses; (9) In any handicap access ramp; (10) In such a manner as to reduce the clear space for the passageway of pedestrians using the sidewalk to less than eight feet in the central business district, or four feet in areas where the sidewalk is six feet or less in width; (11) On any boulevard or other place planted with lawn, flowers, shrubs or trees; (12) So that it is bolted or permanently attached to the sidewalk surface; (13) So that it is weighted down or anchored by any device or material which is not an integral and attached component of the dispensing device, or which is readily separable from the device by an unauthorized person or by weather conditions. 2 Section 3. This ordinance shall become effective as of the date of its publication.
