HomeMy WebLinkAboutResolution No. 228-22 - Resolution - Hilltop House CD2022-006CUP RESOLUTION Approving Conditional Use Permit No. CD2022-05CU6, For A Restricted Development Final Plan For The Development Of An Outdoor Wedding And Event rd Venue In The R-1 District On 8.01 Acres Located West Of 3 Avenue Northwest And South Of Indian Hills Park. WHEREAS, the project is being proposed through the Conditional Use Permit process because proposed “Wedding Venue” in the Mixed Single Family (R-1) district require approval of the City Council; and, WHEREAS, the proposal is consistent with Land Development Manual, and Comprehensive Plan; and WHEREAS, the Council adopts staff findings as described in the revised staff report dated September 14, 2022, as the proposal meets the regulations in R.C.O. § 61.146 Conditional Use Permit; and WHEREAS, on September 14, 2022, the City of Rochester Planning Commission considered this application, and adopted staff findings and recommended approval subject to conditions one through seven proposed by the Planning Department. WHEREAS, on October 3, 2022, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to conditions one through seven. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated ten conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit No. CD2022- 006CUP, requested by Jon Ryan, subject to the seven conditions of approval shown below. CONDITIONS 1. The applicant shall revise the project plans as follows: a. Sign standard shall be changed from D to R b. Lighting standard shall be changed from E to R c. Proposed easements as required by RPU-Water shall be shown on a revised site plan. 2. The applicant shall revise the project narrative as follows: a. Specify that no activities shall occur within the existing residence b. Change hours of operation from noon to 11pm3. 3. The existing fence, which is located in an easement required by RPU-Water shall be removed. 4. Proposed easements must be recorded prior to an event held on the site, and recording of the Final Plat. 5. Grading & Drainage Plan approval will be required, as well as payment of any applicable Storm Water Management Plan Area Charge (SWMPAC). 6. In lieu of constructing pedestrian facilities along the frontage of 3rd Avenue NW, including sidewalk through all drive approaches serving the property, the Owner shall execute a Pedestrian Facilities and Driveway Approach Access Agreement to memorialize its obligation for providing said facilities in the future, prior to any event held on the site. 7. The Owners are responsible for assuring the requirements of any codes and local ordinances are met for each event, and ensuring that the Renter is also aware of those requirements. The tent must be inspected by the FMO prior to any public use.
