NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on October 3, 2022, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: That part of the Northwest Quarter of Section 9, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Beginning at the northwest corner of said Northwest Quarter; thence South 00 degrees 14 minutes 30 seconds East (Note: All bearings are in relationship with the west line of said Northwest Quarter, which is assumed) along the west line of said Northwest Quarter for a distance of 2616.11 feet to the southwest corner of said Northwest Quarter; thence North 89 degrees 04 minutes 50 seconds East along the south line of said Northwest Quarter for a distance of 890.52 feet; thence North 00 degrees 55 minutes 38 seconds West for a distance of 1890.04 feet to the southwest corner of Block 1, STUVE’S THIRD SUBDIVISION; thence continue North 00 degrees 55 minutes 38 seconds West along the west line of said Block 1 for a distance of 726.00 feet to the north line of said Northwest Quarter; thence South 89 degrees 04 minutes 22 seconds West along the north line of said Northwest Quarter for a distance of 859.22 feet to the point of beginning. EXCEPT That part of the Northwest Quarter of the Northwest Quarter of Section 9, Township 107 North, Range 14 West, shown as Parcel 532D on MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NO. 55-65 as the same is on file and of record in the office of the County Recorder in and for Olmsted County, Minnesota. AND EXCEPT That part of the West 120.00 feet of the North 105.00 feet of the Northwest Quarter of the Northwest Quarter of Section 9, Township 107 North, Range 14 West, Olmsted County, Minnesota, lying southerly of the south line of Parcel 532D of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NO. 55-65, according to the recorded plat thereof. AND EXCEPT That part of the East 95.00 feet of the West 625.00 feet of the North 95.00 feet of said Northwest Quarter of Northwest Quarter lying southerly of the south line of Parcel 532D of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NO. 55- 65, according to the recorded plat thereof. TO BE KNOWN as “Mercy Hill First”, submitted by Pastor Fred Shirley, Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to recording the Final Plat, Olmsted County GIS fees shall be paid. 2. Prior to recording the Final Plat, Applicant’s boulevard tree obligation for Lot 2 shall be met. 3. Prior to recording the Final Plat, the applicant shall enter into an agreement with and RPU Water for addressing future water main extensions as described in the redline comments provided by RPU. 4. As there are two existing parks nearby (North Park & Summit Point Park), cash in lieu of land will be required of future residential development for parkland dedication. 5. Prior to printing and submittal of Final Plat mylars, the applicant shall submit a revised final plat to Community Development for the review and acceptance by the City and Rochester Public Utilities. Said revision shall address the below referenced corrections: a. References to Official Street Map No. 17 should be removed from the Final Plat mylar document. b. The short segment of controlled access along extending into the public right-of-way for 37th Avenue NW should be removed from the Final Plat mylar document. c. The lot labeled as Lot 3, Block 2 on the plat, south of Winesap Dr NW, should be labeled as “Lot 1, Block 2”. d. Easements shall be corrected on the final plat to the satisfaction of RPU Electric. e. Easements shall be corrected on the final plat to the satisfaction of RPU Water. f. The 37th Avenue NW right of way, as established by the City Engineer shall be represented on the final plat prior to recording.
