HomeMy WebLinkAboutResolution No. 247-22 - Resolution - Per- and Polyfluoroalkyl Substances MOU RESOLUTION Authorizing execution of a Memorandum of Understanding between the City of Rochester and the Minnesota Pollution Control Agency for the Statewide Monitoring of Per- and Polyfluoroalkyl Substances. WHEREAS, Per- and Polyfluoroalkyl Substances (PFAS) are a known class of environmental contaminants with thousands of unique chemical structures which are persistent in the environment, bio-accumulative, and are in widespread use in industrial, commercial, and household applications; and WHEREAS, municipal wastewater treatment facilities are a receiver of PFAS and can be a conduit for the discharge of PFAS into the environment; and WHEREAS, the Minnesota Pollution Control Agency (MPCA) has regulatory authority over the City of Rochester’s (City) sanitary sewer collection system and water reclamation plant and exercises that authority through the issuance of a National Pollutant Discharge Elimination Discharge (NPDES) wastewater permit to the City; and WHEREAS, the MPCA has established goals to identify and reduce PFAS in the environment through implementation of its 2022 PFAS Monitoring Plan; and WHEREAS, in an effort to collaborate with the City and approximately 90 other Cities with wastewater treatment plants in Minnesota, the MPCA has asked that the monitoring be completed outside the City’s NPDES wastewater permit, through the use of the Memorandum of Understanding (MOU); and WHEREAS, by signing the proposed MOU, the City is agreeing to completing the actions specifically identified in the MOU which includes but is not limited to: 1. Drafting and submitting a PFAS Sampling Plan; 2. Collecting two quarterly influent samples with the potential to collect two additional quarterly influent samples; 3. Inventorying potential sources, developing a PFAS Pollutant Management Plan, and working with dischargers to the City’s collection and treatment system to reduce PFAS in wastewater influen t; and WHEREAS, the MOU is a voluntary agreement and can be nullified by either party at any time. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester that execution of the Memorandum of Understanding between the City of Rochester and the Minnesota Pollution Control Agency for the Statewide Monitoring of Per- and Polyfluoroalkyl Substances is authorized.
