Finding Parcel 640241071302 to be Occupied by a Structurally Substandard
Building.
BE IT RESOLVED by the Board of Commissioners (the “Board”) of the Rochester
Economic Development Authority (the “EDA”) and the Common Council (the “Council”)
of the City of Rochester, Minnesota (the “City”), as follows:
Section 1. Recitals.
1.01 It has been proposed that the EDA create, within the EDA’s area of operation, one
or more redevelopment tax increment financing districts within the meaning of
Minnesota Statutes, Section 469.174, subd. 10 (the “TIF District”) which will
include certain property located at 201 9th Street SE, Rochester, Minnesota,
Parcel Number 640241071302 (the “Property”).
1.02 In order to create this type of tax increment financing district, the EDA must make
a determination before the demolition or removal of substandard buildings or other
improvements, by resolution, that the following conditions existed: (i) that parcels
consisting of 70 percent of the area of the district are occupied by buildings, streets,
utilities, or other improvements and (ii) more than 50 percent of the buildings, not
including outbuildings, are structurally substandard to a degree requiring
substantial renovation or clearance.
1.03 A parcel is deemed to be occupied by a structurally substandard building if it is
occupied by a substandard building within three years of the filing of the request
for certification of the parcel as part of the tax increment financing district with the
county auditor; and if certain other conditions are met.
Section 2. Findings.
2.01. Based on the Redevelopment Eligibility Assessment prepared by Armon
Architecture and dated October 26, 2022 (the “Report”) and in satisfaction of
Minnesota Statutes Section 469.174, Subdivisions 10(a)(1) and (d)(3), the Council
and the Board hereby find: (a) that 99% of the Property is occupied by buildings,
streets, utilities, or other improvements and (b) that the only building the
(“Building”), not including outbuildings, (100% of buildings on the Property) is
structurally substandard to a degree requiring substantial renovation or clearance.
2.02. Subject to satisfying all the conditions required by law including, without limitation,
holding a public hearing thereon, the EDA and the City intend to include the parcel
within the proposed TIF District.

Section 3. Development and Demolition Agreement. A Development and
Demolition Agreement (the “Agreement”) between the EDA and Camegaran, LLC,
a Minnesota limited liability corporation (the “Developer”), pursuant to which the
Developer will demolish the Building, at its sole expense, has been prepared and
is on file with the EDA Secretary. The Agreement is hereby approved in
substantially the form on file, and the President and Secretary are authorized to
sign the Agreement on behalf of the EDA.
