AN ORDINANCE CREATING SECTION 60.500.050D,
CREATING SUBPARAGRAPH (f) OF PARAGRAPH 4 OF
CLAUSE C OF SECTION 60.200.040C, AMENDING
SUBPARAGRAPH (d) OF PARAGRAPH 4 OF CLAUSE C OF
SECTION 60.200.040C, AMENDING TABLE 500.01-1 OF
CLAUSE B OF SECTION 60.500.010 AND AMENDING TITLE
OF SECTION 60.500.050 OF THE UNIFIED DEVELOPMENT
CODE.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Section 60.500.050D of the Unified Development Code is hereby
created to read as follows:
Section 60.500.050D - Property Placement or Removal on Historic Inventory
D. Property Placement on Historic Inventory
1. Purpose
The Historic Property Inventory is intended to identify buildings,
structures, sites, objects, landscapes and/or districts located in the
City that may meet the evaluation criteria in Section 60.200.040C.5
for possible future landmark designation.
2. Applicability
This section applies to the consideration of adding or removing
properties from the historic property inventory.
3. Procedure for adding properties to the inventory
a. Anyone may identify and make known to the Commission,
historic properties, of which the Commission may consider
adding to the inventory.
b. The Heritage Preservation Commission (HPC) may place a
property on the Historic Property Inventory, by majority vote.

c. Properties designated as potential landmarks prior to
December 31, 2022, shall be transferred to the historic
property inventory for the purposes of this UDC.
4. Procedure for removing properties from the inventory
a. The property owner may request removal of their property
from the inventory by providing evidence that the property
does not meet criteria for designation as a landmark property.
b. If the HPC determines that it should be removed from the
inventory, they shall do so by majority vote.
5. Criteria for placement or removal of a property to the
inventory
Criteria from Section 60.200.040C.5 shall be used by the HPC to
determine adding a property or removing one from the inventory.
Section 2. Subparagraph (f) of Paragraph 4 of Clause C of Section 60.200.040 of
the Unified Development Code is hereby created to read as follows:
f. Removal of property from the historic property inventory. The owner
of a property on the inventory may apply for its removal from the inventory
through the process described in Section 60.500.050D.
Section 3. Subparagraph (d) of Paragraph 4 of Clause (C) of Section
60.200.040C the Unified Development Code is hereby amended to read as follows:
d. The Heritage Preservation Commission may place a property on the Historic
Property Inventory, following the process detailed in Section 60.500.050D, when a
phase I survey documenting how the property meets one or more of the criteria of
Section 60.200.040C5 to support future landmark designation is completed.
1) The HPC’s decision to place a property on the inventory may be appealed to
the City Council pursuant to Section 60.500.030F.
2) The inventory of historic properties shall be established and maintained for
public review by the Community Development Department.

Section 4. Table 500.01-1 of Clause B of Section 60.500.010 relating to the
Decision That May Require by a Designated Authority of the Unified Development Code is
hereby amended to read as follows:

NOTES
\[1\] UDC Text Amendments that involve the HPO or related procedures shall be reviewed by both the Planning Commission
and the Heritage Preservation Commission.
\[2\] Official Zoning Map Amendments that involve designation of HPO landmarks or landmark districts or removal of HPO
landmark designations shall be reviewed by the Heritage Preservation Commission rather than the Planning Commission.
\[3\] Public Meeting rather than Public Hearing is required.

Section 5. The Title of Section 60.500.050 of the Unified Development Code is
hereby amended to read as follows:

Authority
Section 6. This ordinance shall become effective from and after its publication.
