AN ORDINANCE CREATING AND ENACTING
CHAPTER 9-6.1 OF TITLE 9 OF THE ROCHESTER
CODE OF ORDINANCES RELATING TO SIDEWALK
IMPROVEMENT DISTRICT AND REPAIR
MAINTENANCE.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Chapter 9-6.1 of the Rochester Code is hereby created and enacted to read
as follows:
9-6.1. SIDEWALK IMPROVEMENT DISTRICT AND REPAIR MAINTENANCE
Sec. 9-6.1-1. Repair by sidewalk improvement district program.
The director of public works or designee shall repair the sidewalk and make it safe for
pedestrians or order the work done by contract in accordance with law. The sidewalk
improvement district cost attributable to each lot or parcel of property shall be reported to the
city clerk.
Sec. 9-6.1-2. Liability for cost.
In accordance with Minn. Stats. § 435.44, the total costs of sidewalk district improvements
will be apportioned and assessed to all parcels or tracts of land located in the established
sidewalk improvement district on a uniform basis as to each classification of real estate. The City
will certify to the county auditor for collection with taxes the costs on all sidewalk district
improvements over a period of five years on equal annual installments.
Sec. 9-6.1-3. Description of district area and rate.
Each calendar year, the area of the city to be included within the sidewalk improvement
district will be brought to council for approval. The sidewalk improvement district boundary and
rate will be established by resolution. Property owners will be notified by mail they are able to
attend the open comment period in the council meeting that will establish the sidewalk
improvement boundary, establish the rates, and award the contract.
Sec. 9-6.1-4. Assessment or certification of cost
The city clerk shall list the total sidewalk improvement charges for each separate lot or
parcel to which they are attributable under this chapter. After the sidewalk improvement district
has been completed, the city will certify to the county auditor for collection with taxes the
following year, along with current taxes as otherwise provided for by state law or the Charter.
Section 2. This ordinance shall become effective on February 1, 2023.
