No. 3008, Article 2, Section. 6, Allowing The City Of Rochester To Issue An On-Sale Wine And Malt Liquor License To A Non Profit Association Comprised Of Members Participating In Athletic Competitions And Related Events At The Mcquillan Park Softball Complex. WHEREAS, Laws 2022, Regular Session, Chapter 86 s.f. no. 3008, article 2, section. 6, allows the City of Rochester to issue an on-sale wine and malt liquor license to a non-profit association comprised of members participating in athletic competitions and related events at the McQuillan Park Softball Complex; and, WHEREAS, Minnesota Statute 645.021 requires the City to pass a resolution authorizing and adopting this change; and, WHEREAS, the Regular Session Law is effective upon approval by a majority vote of the City council and filing of a Certificate of Approval with the Minnesota Secretary of State, all in accordance with Minnesota Statutes 645.021 subdivisions 2 and 3. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the Council, pursuant to R.C.O. Sec. 5-19-5(b), does hereby declare the Rochester Downtown Alliance – World Cup Viewing Party event as a Community Festival. BE IT FURTHER RESOLVED by the Common Council of the City of Rochester, Minnesota, that: 1. The 2022 Regular Session Law, Chapter 86 s.f. no. 3008, article 2, section. 6 is hereby approved in all respects. 2. The City Clerk is authorized and directed to file with the Minnesota Secretary of State a certified copy of this resolution and the appropriate certificate in the form prescribed by the Minnesota State Attorney General. 3. The City of Rochester staff is authorized and directed to take all actions necessary to implement the 2022 Regular Session Law and bring before this City Council further proceedings as necessary to implement the 2022 Regular Session Law.
