HomeMy WebLinkAboutResolution No. 077-15• 077-15 F4 RESOLUTION WHEREAS, Buddy D. Webb Architects applied for an amendment to the 41st Street Plaza Project Development Plan in the Arboretum Special District #R00001 SD to permit the construction of a one-story 10,000 square feet retail use facility. The property is located northwest of the intersection of 41 st Street N.W., and 315t Avenue N.W.; and, WHEREAS, the proposed development is subject to the provisions of Ordinance #2247, which establishes the Arboretum Special District and provides for procedures for approval of projects within the Special District. In this instance, A Type III, Phase II review procedure is necessary for both the project development plan phase and the final development plan phase of the review. This requires public hearings at both the Planning Commission and the City Council. According to the R.C.O. §60.327, this application will need to be measured against the criteria applicable for conditional use permits (Section 61.146) and also for a Restricted Development Preliminary Plan (Section 62.708); and, WHEREAS, a Project Development Plan (preliminary plan) was approved for this property in December 2014, which included the retail use for the subject site and standards to be satisfied. The applicant is now proposing a 10,000 square foot building for an O'Reilly's Auto Parts. The applicant proposed 50 parking spaces, which exceeds the required 23. Sixteen columnar Norway Maples are proposed along the frontage, satisfying the boulevard • tree requirement. The final site plan has modified the northern access point to satisfy access management standards; and, WHEREAS, with respect to R.C.O. §61.146 and assuming this application were approved subject to conditions or modifications, the Planning Department staff suggests that findings within this Section could not be made to support denial of this request; and, WHEREAS, R.C.O. § 62.708 (Criteria for Type III Developments) provides the relevant criteria for the review of this application; and, WHEREAS, the Planning Department applied the criteria found at Section 62.708 to this application and prepared the following findings of fact: 2) Final Development Plan Criteria: a) Public Facility Design: An approved grading and drainage plan is required prior to construction. Extension of any public utilities will require approved construction plans. b) Geologic Hazards: There are no known geologic hazards on this site. 077-15 F4 c) Access Effect: This project will be served by a private road system circulating through the Project Development Plan site, which will access public roads at 31st Avenue NW and 41st Street NW. d) Pedestrian Circulation: This site proposes pedestrian connection via striped walkway and hard surfacing to City sidewalk. e) Foundation and Site Plantings: This site proposes to satisfy boulevard tree requirements, per submitted plans. Sixteen (16) boulevard trees are shown, along the south and east frontages. f) Site Status: Installation of public infrastructure will require approved construction plans. The applicant will need to work with the City to obtain an approved grading and drainage plan. g) Screening and Bufferyards: Given the location of this site and adjacent uses, this site does not require bufferying and screening beyond required boulevard trees. h) Final Building Design: The final building design is consistent • with the principles identified in preliminary development plan relative to Height Impact, Setbacks, and Internal Site Design. i) Internal Circulation Areas: Plans for off-street parking and loading areas and circulation aisles to serve these areas meet ordinance requirements in terms of design. j) Ordinance Requirements: Pursuant to satisfying staff recommended conditions or modifications, the proposed development is consistent with the requirements of the underlying zoning district for similar uses, and with general standards such as traffic visibility and emergency access. Signage shall be approved by separate sign permit submissions and shall satisfy the Project Development Plan standards. k) Non -Vehicular and Alternate Travel Modes: The proposed development provides direct and convenient pedestrian access to the building entrance(s) from public sidewalks and onsite parking areas; and, 0 2 • 077-15 F4 WHEREAS, on January 28, 2015, the Rochester Planning and Zoning Commission held a public hearing on this restricted development preliminary plan, reviewed the application according to the requirements of Section 62.708, adopted the Planning Department's recommended findings of fact and recommended approval of the application subject to the following conditions: 1. Applicant should provide the additional plans and revisions as listed at least two weeks prior to the meeting this item is scheduled for a public hearing with the City Council. A. The site plan shall identify a summary zoning information table that includes total site area and proposed Floor Area Ratio. B. Building elevation plans shall include information for trash enclosure. 2. The applicant shall satisfy boulevard tree requirements per Park and Recreation Department comments and Zoning Ordinance regulations. Sixteen boulevard trees shall be required. 3. The applicant shall satisfy the following Public Works comments: • A. Grading & Drainage Plan approval is required prior to construction; B. Development of this property is subject to the Plant Investment Fee (PIF) that will be calculated and collected through the Building Permit review and approval process. 4. The 1 Y4" copper water service shown is not an approved size and must be increased to a 1 '/2" copper line, per RPU Water comments. 5. Separate sign permits must be submitted and approved prior to construction of any signage onsite; and, WHEREAS, the Common Council held a public hearing on the restricted development preliminary plan request on February 18, 2015, and permitted all interested persons to be heard; and, WHEREAS, based upon a preponderance and substantial weight of the evidence submitted at the February 18th public hearing, the Common Council determines that the Applicant satisfied the criteria of Section 62.708 if the above conditions were satisfied. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of r-I LJ • 077-15 F4 Rochester that the amendment to the 41 st Street Plaza Project Development Plan in the Arboretum Special District #R2014-002SD requested by Buddy D.
