RESOLUTION
BE IT RESOLVED by the Common Council of the City of Rochester that the City approve
of the purchase of approximately 76,438 square feet of Highway 52 excess right-of-way located
north of the Hillcrest Shopping Center and west of Assisi Heights Drive from the State of
Minnesota.
BE IT FURTHER RESOLVED that the City approve the sale of approximately 76,438
square feet of Highway 52 excess right-of-way located north of the Hillcrest Shopping Center
and west of Assisi Heights Drive to Premier Bank. ,
BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute
the Purchase Agreement with Premier Bank.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute
the Purchase Agreement with the State of Minnesota only after the City receives an executed
Purchase Agreement from Premier Bank.
BE IT FURTHER RESOLVED that it is the judgment of the Common Council that the
• purchase of the real property covered by this resolution has no relationship to the City's
comprehensive plan. As such, the Council hereby dispenses with the requirement of Minnesota
Statute Section 462.356, Subd. 2 that might require the City Planning and Zoning Commission to
perform a comprehensive plan compliance review of the action described by this resolution.
BE IT FURTHER RESOLVED that the Common Council determines the purchase and
sale of the real property covered by this resolution would promote the public's health, safety or
welfare.
