PersPolicy.SickLeave MAYOR OF SAID CITY 0 R CITY OF ROCHESTER ORGANIZATIONAL POLICY is UNUSED SICK LEAVE PROGRAM Policy It is the policy of the City of Rochester to convert a portion of an eligible employee's unused sick leave account upon separation of employment and place it in a health care savings plan. Eligibility Regular full-time or regular part-time employees of the City of Rochester who separate em- ployment after ten (10) years of continuous. service are eligible to participate in this program. No employee shall receive benefits under the Unused Sick Leave Program more than one time while employed (or re-employed) by the City of Rochester. Employees, who are members of a bargaining unit, should defer to their respective Collective Bargaining Agreement for information regarding unused sick leave payouts. Guidelines For employees hired prior to April 1, 2013: When an employee terminates employment after ten (10) years of regular full-time or regular part-time employment with the City of Rochester, the City will convert forty (40) percent of the employee's unused sick leave balance to be de- posited to an individual Minnesota State Retirement System (MSRS) Health Care Savpgs Plan (HSCP). After ten (10) years of service, the dollar value of accumulated sick leave hours will be equal to forty (40) percent of the total accumulated sick leave hours at the time of separation multi- plied by the employee's hourly rate of pay at the time of separation. Regular part-time em- ployees (those regularly scheduled for twenty (20) to thirty-nine (39) hours per week) and who are not designated as temporary or seasonal will be eligible to convert forty (40) percent of their accumulated sick leave. For employees hired on or after April 1, 2013: All employees who have accrued ten (10) or more continuous years of full-time or regular part-time service with the City, except those who are discharged for cause, shall be eligible to convert forty percent (40%) of the employee's first twelve hundred (1200) hours of accumulated but unused sick leave balance. This amount shall be deposited into an individual MSRS Health Care Savings Plan. The Health Care Savings Plan is a tax-free savings account. This account can be used to cover medically necessary expenses and pay health care and long-term care insurance pre- miums after employment separation. The money deposited is tax deferred and payouts are tax free for medically related expenses that the participant incurs subject to the rules applied by MSRS. • In case of permanent disability of an active employee, as determined by the Public Employ- ees Retirement Association (PERA), an amount equal to one hundred (100%) percent of un- used sick leave will be deposited into a MSRS Health Care Savings Plan for the use of the CITY OF ROCHESTER ORGANIZATIONAL POLICY • employee as governed by MSRS rules. In case of death of an active employee who has a dependent(s), an amount equal to one hundred percent (100%) of the unused sick leave bal ance will be paid in cash (less required State and Federal withholdings) to the dependent(s). For the purpose of this policy, the definition of "dependent" will be the same as that defined in Minnesota Statute 471.61, Group Benefits for Officers, Employees, Retirees, Subd 1a.
