HomeMy WebLinkAboutResolution No. 164-13Form 12 RESOLUTION WHEREAS, pursuant to proper notice duly given as required by law, the Common Council met on the 1st day of April, 2013, for the purpose of considering the propo ed assessment of the following improvement(s): Project No. 6216-2-09 (J-7267) "Reconstruct 16" Street SE from roadway to 3r� Avenue SE" and hearing and passing upon all objection thereto; and, WHEREAS, the Common Council heard and considered all testimony presented. The Council assessed all properties with the exception of properties whose owners filed written objections. Those properties are Pin #s 8200, 50872, 8204, 8209, 8212, 8219, 8218, 8221, 8232. The assessments will be considered at an adjourned Council meeting on the October 21, 2013. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota: Such proposed assessment, a copy of which is a�ached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands described therein, and each tract of land therein included is hereby found to be benefited by the proposed improvements) in the amount of the assessment levied against it. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on the first Monday in January, 2014 and shall bear interest at the rate of 5.00 percent per annum from the date of this resolution until December 31, 2013. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. He may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and he may pay the remaining princi al balance of the assessment to the City Treasurer. The Gi Clerk shall file the 4 ty e assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before October 10th of each year the total amount of installments and interest which are to become due in the following year on the assessment on each parcel of land included in the assessment roll. The City Clerk shall file for recording with the Olmsted County Recorder a certified statement containing the legal description of the affected properties and the amount of the assessment deferred on it.
