WHEREAS, the Transportation Security Administration ("TSA") of the U.S. Department
of Transportation has received a written statement from the Rochester Police Chief and the
Rochester City Attorney concluding that private security personnel at the Rochester
International Airport possess under Minnesota law the legal authority to make arrests for
offenses committed in their presence; and
WHEREAS, the TSA wishes the City of Rochester to formally adopt this conclusion 'as
the City's conclusion; and,
WHEREAS, the City of Rochester does indeed adopt the Police Chief's and the City
Attorney's conclusion as the City's conclusion.
NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of
Rochester that the City does hereby state that all individuals providing law enforcement
support at the security checkpoint at the Rochester International Airport the costs of which the
City of Rochester seeks reimbursement from the TSA in fact meet all of the criteria specified in
•49 C.F.R. §1542.217.
