HomeMy WebLinkAboutResolution No. 020-14 rr • RESOLUTION WHEREAS, David Reynolds applied for a Type III, Phase III Conditional Use Permit (#2013-29) to allow for the establishment of two ground floor apartments within the building located at 223 North Broadway. The property is located along the south side of Third Street N.W., and along the west side of North Broadway; and, WHEREAS, R.C.O. §61.146 (Standards for Conditional Use Permits) provides the relevant criteria for the review of this application; and, WHEREAS, on December 11, 2013, the Rochester Planning and Zoning Commission held a public hearing on said conditional use permit, reviewed the application according to the requirements of R.C.O. §61.146, and recommended approval of the request for a conditional use permit based upon Planning Department staffs recommendation, subject to the following conditions: 1. The site plan should be modified: A. So that the parking space along Broadway Avenue does not cross over the property line; and B. To show the recommended parking space in the northwest corner • of the site as shown on the staff mark-up to accommodate for the four parking spaces that are required. 2. Landscaping shall be constructed as shown on the site plan to meet the required five percent minimum landscaping requirement of the CDC- Fringe Zoning District. , 3. All five residential apartments must be plumbed together from the previously determined 1" "house" water meter on the combined domestic/fire service line; and, WHEREAS, the Common Council held a public hearing on the conditional use permit request on January 8, 2014, and permitted all interested persons to be heard; and, WHEREAS, the Common Council adopted the Planning Department's recommended findings of fact as they pertain to the requested conditional use permit request; and, WHEREAS, following the January 8th public hearing, the Common Council determined that the applicant satisfied the conditions of R.C.O. §61.146 by a preponderance of the evidence submitted at the public hearing if the applicant satisfied the above three conditions. 1 ,II I • NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City .of Rochester that the Conditional Use Permit#2013-29 requested by David Reynolds is granted. BE IT FURTHER RESOLVED that the approval of Conditional Use Permit#2013-29 is subject to compliance with conditions #1 -#3 stated above.
