HomeMy WebLinkAboutResolution No. 038-14 01 • RESOLUTION WHEREAS, U.S. Bank National Association applied for a Type III, Phase III Conditional Use Permit (#2013-31) to allow for the establishment of a parking facility on the property located at 402 First Avenue S.W. A portion of the existing building on the property will be demolished for the parking facility. The property is located along the south side of Fourth Street S.W., and along the east side of First Avenue S.W.; and, WHEREAS, R.C.O. §61.146 (Standards for Conditional Use Permits) provides the relevant criteria for the review of this application; and, WHEREAS, on January 8, 2014, the Rochester Planning and Zoning Commission held a public hearing on said conditional use permit, reviewed the application according to the requirements of R.C.O. §61.146, and recommended approval of the request for a conditional use permit based upon Planning Department staff's recommended findings of fact, subject to the following conditions: 1. The design of the parking facility shall be configured as shown on the staff revised site plan. e 2. The fifteen foot wide buffer shown on the staff revised site plan shall be designed for use as a pedestrian plaza with public seating, public art and • /or landscape area. 3. The applicant shall coordinate with the Rochester Public Works Department to determine if a Grading and Drainage Plan is needed. 4. Documentation must be provided on the cost of property improvements , and demolition cost to determine if the proposal is subject to the Boulevard Tree Ordinance; and, 5. Any exterior lighting provided for a parking facility shall utilize full-cutoff luminaries. If pole mounted, the maximum height of the luminaries shall be 18 feet with a maximum permitted illumination of one footcandle at the property line; and, WHEREAS, the Common Council held a public hearing on the conditional use permit request on February 3, 2014, and permitted all interested persons to be heard; and, WHEREAS, the Common Council adopted the Planning Department's recommended findings of fact as they pertain to the requested conditional use permit request; and, WHEREAS, at the February 3rd public hearing, the Council deleted condition #1 in response to the Applicant's submission of a revised site plan; and, 1 WHEREAS, following the February 3`d public hearing, the Common Council determined that the applicant satisfied the conditions of R.C.O. §61.146 by a preponderance of the evidence submitted at the public hearing if the applicant satisfied the above four conditions (conditions #2 -#5). NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Conditional Use Permit #2013-31 requested by U.S. Bank National Association is granted. BE IT FURTHER RESOLVED that the approval of Conditional Use Permit#2013-31 is subject to compliance with the four conditions stated above (conditions #2 -#5).
