BE IT RESOLVED by the Common Council of the City of Rochester that the City
authorize the sale of Lot 1, Block 4, 55`" Street Estates First Subdivision (PIN #31471) to
Chateau LLC subject to the condition that the buyer obtain a zoning district amendment for the
west portion of the property, the abandoned Chateau Road, and the Bigalke property.
BE IT FURTHER RESOLVED that the Cit execute a purchase agreement with Chateau
Circle LLC for the City's sale of Lot 1, Block 4, 55t Street Estates First Subdivision.
BE IT FURTHER RESOLVED that it is the judgment of the Common Council that the
acquisition of the real property covered by this resolution has no relationship to the City's
comprehensive plan. As such, the Council hereby dispenses with the requirement of Minnesota
Statute Section 462.356, Subd. 2 that might require the City Planning and Zoning Commission to
perform a comprehensive plan compliance review of the action described by this resolution.
The Mayor and City Clerk are authorized to execute this agreement and any other
necessary documents needed in order to implement this resolution on behalf of the City.
