HomeMy WebLinkAboutResolution No. 179-14 r l7f RESOLUTION WHEREAS, U.S. Bank National Association applied for an amendment to Conditional Use Permit (#R2013-031) that would allow for the addition of five additional parking spaces on the property located at 402 First Avenue S.W., and, WHEREAS, R.C.O. §61,146 (Standards for Conditional Use Permits) provides the relevant criteria for the review of this application; and, WHEREAS, on April 9, 2014, the Rochester Planning and Zoning Commission held a public hearing on said conditional use permit, reviewed the application according to the requirements of R.C.O. §61.146 and determined that the application satisfied the applicable criteria if the following conditions were satisfied: 1. The four conditions that the Council placed on approval of the original condition use permit on 2/3/14 still apply. 2. A minimum landscape buffer along 4`h Street SW shall be a minimum of six feet in width and planted with bushes that will form a hedge maintained between 30 and 42 inches. • 3. The landscape buffer along the alley where the amendment is shall be increased in width to be consistent with the landscape buffer further to the south; and, WHEREAS, on May 5, 2014, the Common Council held a public hearing on the conditional use request and permitted all interested persons to be heard; and, WHEREAS, at the May 5"' public hearing, the Council amended condition #2 so as to read as follows: 2. A minimum landscape buffer along 4th Street SW shall be a minimum of 17 feet, one inch in width and planted with bushes that will form a hedge maintained between 30 and 42 inches. WHEREAS, the Common Council determined that the applicant satisfied the conditions of R.C.O. §61.146 by a preponderance of the evidence submitted at the public hearing subject to the above three conditions as amended above; and, WHEREAS, the Applicant's representative agreed to all of the recommended conditions of approval as amended above. • 1 • NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the amendment to Conditional Use Permit (#R2013-031) that would allow for the addition of five additional parking spaces on the property located at 402 First Avenue S.W., is granted subject to the above three conditions as amended above.
