APPROVING LODGING TAX PURSUANT TO SPECIAL LEGISLATION FOR MAYO
CIVIC CENTER COMPLEX EXPANSION
BE IT RESOLVED By the Common Council (the "Council") of the City of Rochester,
Olmsted County, Minnesota (the "City") as follows:
Section 1. Background.
1.01. The Minnesota Legislature enacted Laws 2013, Chapter 143, Article 8, Section 46,
relating to the Rochester lodging tax (the "Special Law").
1.02. In accordance with Minnesota Statutes, Section 645.021, the Council has approved
the Special Law and the City Clerk has filed a certificate of approval with the Minnesota Secretary
of State.
1.03. In accordance with Minnesota Statutes, Section 16A.86, the City has submitted a
request for an appropriation of State money for a capital improvement project (the "Funding
Request") in connection with the proposed Mayo Civic Center complex expansion (as more fully
described in the Special Law and the Funding Request, the "Project").
• 1.04. In accordance with the Special Law, the Council must approve a financial
package for the Project prior to authorizing the lodging tax provided for in the Special Law.
1.05. Section III of the Funding Request sets forth the proposed sources and uses for the
Project (the "Sources and Uses").
Section 2. Approval of Financial Package and Lodging Tax.
2.01. In accordance with the Special Law, the Council hereby approves the Sources and
Uses as the total financial package for the Project; such approval includes, without limitation, the
use of the lodging tax as set forth in Subdivision 1 a of the Special Law and general obligation bonds
of the City as set forth in Subdivision 2a of the Special Law (collectively, the "Financial Package").
2.02. The approval hereby given to the Financial Package includes approval of such
additional details therein as may be necessary and appropriate and such modifications thereof,
deletions therefrom and additions thereto as may be necessary and appropriate and approved by the
Council from time to time including, without limitation, modifications to the scope of the Project
and the sources of financing in the event the Funding Request is not approved by the State
Legislature in the 2014 legislative session. The Project may be undertaken in one or more phases
including, without limitation, an initial phase consisting of various improvements to the Mayo Civic
Center Arena and Auditorium ("Phase I"), to the extent of financing sources available from time to
time.
• 2.03. The City hereby authorizes and imposes, in addition to the tax authorized by
• Subdivision 1 of Laws 2002, Chapter 377, Article 3, Section 25, as amended by Laws 2009,
Chapter 88, Article 4, Section 19, and Laws 2010, Chapter 389, Article 5, Section 3, a tax of 3% on
the gross receipts from the furnishing for consideration of lodging at a hotel, motel, rooming house,
tourist court, or resort, other than the renting or leasing of it for a continuous period of 30 days or
more (the "Lodging Tax").

2.04. City officials, staff and consultants are hereby authorized and directed to take any
and all other steps necessary or convenient in order to implement the Lodging Tax described fil this
resolution and to undertake the Project.
Adopted by the Common Council of the City of Rochester, Minnesota, this 19th day of
August, 2013.
