• RESOLUTION
WHEREAS, on September 6, 2006, the Common Council of the City of Rochester
adopted Resolution No. 448-06 vacating the 12-foot wide utility/walkway easement located
between Lots 10 & 11, Block 2, Wilshire Estates Addition and Lots 13 & 14 Wilshire Estates
Third Subdivision located east of 13th Avenue N.E., south of City View Court N.E., and north of
Wilshire Drive N.E.; and,
WHEREAS, Resolution No. 448-06 contained a legal description of the area to be
vacated; and,
WHEREAS, the legal description found within Resolution No. 448-06 is in error and
needs to be replaced with an accurate legal description; and,
WHEREAS, the Council wishes to amend Resolution No. 448-06 so as to delete the legal
description found within the Resolution and to insert in lieu thereof the following accurate legal
description:
The North/South 12-foot wide walkway easement between City View Court N.E.,
and Wilshire Drive N.E., located between Lots 10 and 11, Block 2, Wilshire
• Estates Addition and Lots 13 and 14, Block 2, Wilshire Estates Third Subdivision,
Rochester, Minnesota.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that Resolution No. 448-06 be amended so as to delete the legal description found
within the Resolution and to insert in lieu thereof the following legal description:
The North/South 12-foot wide walkway easement between City View Court N.E.,
and Wilshire Drive N.E., located between Lots 10 and 11, Block 2, Wilshire
Estates Addition and Lots 13 and 14, Block 2, Wilshire Estates Third Subdivision,
Rochester, Minnesota.
BE IT FURTHER RESOLVED that the remainder of Resolution No. 448-06 be reaffirmed
and remain in effect.
